“二孩”政策下女性勞動權(quán)益法律保護(hù)研究

【摘要】:2015年10月29日,中國共產(chǎn)黨第十八屆中央委員會第五次全體會議審議通過了《中共中央關(guān)于制定國民經(jīng)濟(jì)和社會發(fā)展第十三個五年規(guī)劃的建議》,全面實(shí)施一對夫婦可生育兩個孩子政策。目前,多個省份已完成了地方人口與計(jì)劃生育條例的修訂,全面二孩政策正在依法有序?qū)嵤。論文在“二孩”政策?shí)施的背景下,在對女性勞動權(quán)益產(chǎn)生的影響進(jìn)行梳理的基礎(chǔ)上,對女性勞動權(quán)益法律保護(hù)進(jìn)行了較系統(tǒng)的研究。文章主要分為三個部分。第一部分通過一系列案例和調(diào)研數(shù)據(jù),對“二孩”政策下女性勞動權(quán)益受到侵害的具體表現(xiàn)進(jìn)行了分析,主要從女性求職和女性就職兩方面展開。在女性求職過程中,因?yàn)椤岸ⅰ闭叩膶?shí)施,其所面臨的招聘性歧視更加嚴(yán)重。而已經(jīng)就職的女性也受到“二孩”政策的影響,如女性勞動者因?yàn)樯岸ⅰ北唤夤、調(diào)崗降薪等。第二部分從立法和司法兩方面,分析了女性勞動權(quán)益法律保護(hù)的現(xiàn)狀,并就不足之處進(jìn)行了剖析。從立法角度看,現(xiàn)有的散見于各種法律法規(guī)中的相關(guān)規(guī)范并不具體明確,缺乏實(shí)際可操作性,而且“二孩”政策出臺后,缺少與其配套的法律法規(guī),來保障女性因?yàn)樯岸ⅰ倍馐芮趾Φ膭趧訖?quán)益。從司法角度看,我國缺少反就業(yè)歧視專門機(jī)構(gòu),而且現(xiàn)行的司法救濟(jì)機(jī)制也存在著諸多缺陷。第三部分主要是提出法律建議。針立法和司法上存在的不足之處,筆者認(rèn)為應(yīng)當(dāng)盡快出臺專門的反就業(yè)歧視法,明確相關(guān)的法律責(zé)任,使得女性維護(hù)自身勞動權(quán)益有法可依,也能夠震懾做出違法行為的用人單位。另外,應(yīng)當(dāng)建立女性勞動權(quán)益保護(hù)的公益訴訟機(jī)制,避免女性勞動者因?yàn)槠淙鮿莸匚欢y以維護(hù)其勞動權(quán)益。
[Abstract]:On 29 October 2015, the Fifth Plenary session of the 18th Central Committee of the Communist Party of China deliberated and adopted the recommendations of the CPC Central Committee on the formulation of the 13th Five-Year Plan for National Economic and Social Development, Fully implement the policy of having two children for a couple. At present, several provinces have completed the revision of local population and family planning regulations, and the comprehensive two-child policy is being carried out in an orderly manner. Under the background of the implementation of the "two-child" policy, this paper makes a systematic study on the legal protection of the female labor rights and interests on the basis of combing the influence on the female labor rights and interests. The article is divided into three parts. The first part, through a series of cases and research data, analyzes the specific performance of the violation of women's labor rights and interests under the "two-child" policy, mainly from the two aspects of female job hunting and female employment. Because of the implementation of the "two-child" policy, women face more serious discrimination in recruitment. Women who are already employed are also affected by the "two-child" policy, such as the dismissal of female workers for having a second child and a pay cut. The second part analyzes the present situation of the legal protection of female labor rights and interests from the two aspects of legislation and judicature, and analyzes the deficiency. From the legislative point of view, the existing relevant norms scattered in various laws and regulations are not specific, lack of practical maneuverability, and after the introduction of the "two-child" policy, there is a lack of supporting laws and regulations. To protect women because of the birth of "two children" and suffered violations of labor rights and interests. From the judicial point of view, our country lacks the specialized organization of anti-employment discrimination, and the current judicial relief mechanism also has many defects. The third part is mainly to put forward legal suggestions. The author thinks that we should introduce a special law against employment discrimination as soon as possible, make clear the relevant legal responsibility, so that women can maintain their own labor rights and interests in accordance with the law. It can also deter employers who commit illegal acts. In addition, we should establish a public interest litigation mechanism to protect women's labor rights and interests, so as to avoid the difficulty for female workers to safeguard their labor rights and interests because of their weak position.
