我國(guó)企業(yè)懲戒權(quán)濫用法律對(duì)策研究
[Abstract]:The right of punishment is the need for enterprises to ensure the order of production and management and to realize the established objectives of production and management. The right of punishment is closely related to the rights and interests of workers. Once the right of punishment is abused, it will infringe upon the rights and interests of workers. Therefore, it is necessary to restrict the exercise of enterprise disciplinary power in various countries, prevent the abuse of enterprise disciplinary power, reduce the contradiction between enterprises and workers, and balance the interests of both parties. There are many defects in the regulations of the enterprise disciplinary power in the current labor law system of our country. The theoretical research on the enterprise disciplinary power can not meet the needs of reality, and the theory lags behind the practice. On the basis of previous studies, this paper analyzes the causes of the abuse of corporate disciplinary power and the abuse of corporate disciplinary power, and puts forward some legal countermeasures to effectively prevent the abuse of corporate disciplinary power in our country. The purpose of this paper is to enlighten the legislation and judicial practice of preventing the abuse of disciplinary power in our country in the future. In addition to the introduction and conclusion, this article is divided into three chapters. Chapter one: corporate disciplinary power and abuse of corporate disciplinary power. This chapter mainly analyzes the necessity of the existence of enterprise disciplinary power, analyzes the meaning of enterprise disciplinary power from different angles, and analyzes the nature, classification and function of enterprise disciplinary power. At the same time, drawing lessons from the definition of abuse of rights in western countries, the characteristics, performance, harm and reasons of abuse of disciplinary power in enterprises are further elaborated. The second chapter is about how to prevent and deal with the abuse of corporate disciplinary power in our country. This chapter mainly analyzes the legal basis for the prevention and treatment of the abuse of disciplinary power in Chinese enterprises, the problems in preventing and dealing with the abuse of disciplinary power in Chinese enterprises, and the reasons for preventing and dealing with the existing problems in the abuse of disciplinary power in Chinese enterprises. The third chapter effectively prevents our country enterprise discipline right abuse legal countermeasure. From the aspects of perfecting the system of enterprise disciplinary power itself, ensuring the implementation of the system of corporate disciplinary power according to law and the system of supervision and accountability for the abuse of corporate disciplinary power, this chapter puts forward some concrete suggestions for standardizing the exercise of the right to discipline of enterprises in our country.
