我國(guó)休假法律制度研究

【摘要】: 休假權(quán)是休息權(quán)的重要內(nèi)容,在勞動(dòng)權(quán)體系中對(duì)其他權(quán)益起著保障作用,并且休假權(quán)內(nèi)容的豐富和發(fā)展能使勞動(dòng)者更為直接地享受到社會(huì)文明進(jìn)步的成果。這是因?yàn)?有了充足的休息,就能為繼續(xù)工作做好體力和精神的準(zhǔn)備,有了合理的休假,就能為勞動(dòng)者提供充足的時(shí)間學(xué)習(xí)進(jìn)步、交友往來(lái)、聯(lián)系親友、放松心情、歡慶節(jié)日,在這個(gè)過(guò)程中,有助于使勞動(dòng)者體味到生活的樂(lè)趣、身心的愉悅和社會(huì)進(jìn)步的成果,進(jìn)而有利于人們生活質(zhì)量的提高和社會(huì)的穩(wěn)定發(fā)展,由此可見(jiàn),休假制度的設(shè)計(jì)和運(yùn)行承載了多方面的現(xiàn)實(shí)意義。然而,現(xiàn)行的休假制度并未有效的發(fā)揮作用,究其原因,存在法律法規(guī)設(shè)計(jì)的制度不完善,已有規(guī)定多顯立法粗糙并與現(xiàn)實(shí)需求脫節(jié),在運(yùn)行時(shí)勞資雙方的意識(shí)不強(qiáng),有關(guān)部門(mén)執(zhí)法手段單一,制裁措施缺乏約束力等問(wèn)題,故而,分析存在問(wèn)題并提出解決方案成為研究休假權(quán)的時(shí)代課題。本文在分析休假制度的理論基礎(chǔ)和現(xiàn)實(shí)需要的基礎(chǔ)上,重點(diǎn)剖析了現(xiàn)行休假制度的制定和運(yùn)行情況,同時(shí)介紹了國(guó)外相關(guān)先進(jìn)立法的情況,進(jìn)而指出現(xiàn)存問(wèn)題,并且針對(duì)各項(xiàng)問(wèn)題的解決方法提出了幾點(diǎn)建議,以期對(duì)進(jìn)一步研究休假制度提供一些可供參考的資料。
[Abstract]:The right to leave is an important part of the right to rest, which plays an important role in protecting other rights and interests in the system of labor rights, and the enrichment and development of the content of the right to leave can make workers more directly enjoy the fruits of the progress of social civilization. This is because, with adequate rest, we can prepare ourselves physically and mentally for continuing our work, have a reasonable vacation, and provide sufficient time for workers to study and progress, make friends and exchanges, contact relatives and friends, relax their mood, and celebrate the festival. In this process, it is helpful to make the laborer appreciate the pleasure of life, the pleasure of body and mind and the fruits of social progress, and thus contribute to the improvement of people's quality of life and the steady development of society. The design and operation of the leave system carry many practical significance. However, the current vacation system does not play an effective role. The reason is that the system of laws and regulations is not perfect, the legislation has been more rough and out of touch with the actual needs, and the consciousness of both employers and employees is not strong in operation. Because the law enforcement measures of relevant departments are single and the sanction measures lack of binding force, analyzing the existing problems and putting forward solutions have become the times subject of studying the right to leave. Based on the analysis of the theoretical basis and practical needs of the leave system, this paper focuses on the establishment and operation of the current leave system, introduces the relevant advanced legislation in foreign countries, and then points out the existing problems. Some suggestions are put forward to solve the problems in order to provide some references for further study on the vacation system.
