就業(yè)公平保障法律制度研究

【摘要】: 就業(yè)公平是一國就業(yè)問題當(dāng)中最為重要的問題之一,它是否得到有效保障直接關(guān)系到勞動者的基本人權(quán)和社會公平能否得以實(shí)現(xiàn),關(guān)系到社會能否得以和諧發(fā)展。但是,由于我國長期以來都過于關(guān)注宏觀上的經(jīng)濟(jì)總量增長,而忽視了對于在這個(gè)經(jīng)濟(jì)增長過程中出現(xiàn)的,有關(guān)勞動者個(gè)體基本權(quán)利的就業(yè)公平問題的關(guān)注,它的直接后果就是導(dǎo)致實(shí)踐當(dāng)中的就業(yè)不公平行為愈演愈烈,而我國目前不論是在理論上還是在已有的立法當(dāng)中卻并未能對此給予適當(dāng)?shù)姆从?本文就是在這一背景下對于就業(yè)公平當(dāng)中可能涉及的一系列重要問題進(jìn)行了系統(tǒng)而全面地研究。本文共分為七章,第一章是引言,其他章節(jié)具體內(nèi)容如下: 第二章主要對就業(yè)公平的基本概念與原理進(jìn)行了研究。本文認(rèn)為,要搞清就業(yè)公平問題,首要地就是要界定什么是公平、就業(yè)以及就業(yè)公平,它決定了本文研究的基本范疇。因此本章第一節(jié)分別對這三個(gè)概念進(jìn)行了分析。本文認(rèn)為,公平是一種在充分尊重個(gè)人利益基礎(chǔ)上的互利和諧的社會公平。而它的實(shí)現(xiàn)必須遵循三個(gè)基本原則,即應(yīng)得、需要和平等原則;就業(yè)是一個(gè)比較廣泛的概念,它既包括勞動者獲得工作的行為,也包括獲得工作之后的工作狀態(tài),就業(yè)也不僅限于企業(yè)的雇傭行為,而是包括所有的用人單位(含公共機(jī)構(gòu))的雇傭行為;對就業(yè)公平的認(rèn)識則是建立在本文對公平和就業(yè)概念界定的基礎(chǔ)之上,它是一種勞動者在就業(yè)領(lǐng)域符合公平理論之應(yīng)得、需要和平等原則要求的基本人權(quán)。第二節(jié)對就業(yè)公平與就業(yè)自由與就業(yè)效率等相關(guān)概念及其關(guān)系進(jìn)行了辨析,認(rèn)為盡管自由與效率都很重要,但它們都只有在公平的基礎(chǔ)上才能證明其合理性與必要性。 第三章主要論證了市場、政府和法治三大要素在保障就業(yè)公平方面的功能和所擔(dān)任的角色。第一節(jié)首先介紹了市場失靈的基本理論,并在此基礎(chǔ)上指出就業(yè)不公平行為是在市場狀態(tài)下的一種必然行為,也是一種重要的市場失靈。然后本文又對市場本身是否具備自我消除就業(yè)不公平行為的功能進(jìn)行了論證,認(rèn)為市場功能有限,從而為本章第二節(jié)的主題——政府介入就業(yè)市場提供了一定的認(rèn)識基礎(chǔ)。但是,第二節(jié)在具體分析了政府可能扮演的角色之后,認(rèn)為政府相對于市場來說盡管在保障就業(yè)公平方面具有特有的優(yōu)勢,但是政府保障也有缺陷,而且政府在很多時(shí)候甚至本身就是就業(yè)不公平的制造者。第三節(jié)建立在前兩節(jié)的基礎(chǔ)上,詳細(xì)地論證了法治在保障就業(yè)公平方面的決定性作用,并對就業(yè)公平的法治保障當(dāng)中應(yīng)當(dāng)注意的幾個(gè)問題,包括雇主與勞動者的利益平衡問題、就業(yè)公平保障法的效用問題以及就業(yè)公平保障法的公平問題等進(jìn)行了分析。
[Abstract]:Employment equity is one of the most important problems in the employment problem of a country. Whether it is effectively guaranteed or not has a direct bearing on whether the basic human rights of workers and social equity can be realized and whether the society can develop harmoniously. However, since our country has been paying too much attention to macro-economic growth for a long time, it has neglected to pay attention to the issue of employment equity related to the basic rights of workers in the process of economic growth. Its direct consequence is to cause the employment unfair behavior in practice to become more and more serious, but at present our country has not been able to give a proper reflection to this either in theory or in the existing legislation. In this context, this paper makes a systematic and comprehensive study on a series of important issues that may be involved in employment equity. This paper is divided into seven chapters, the first chapter is the introduction, the other chapters are as follows: the second chapter mainly studies the basic concepts and principles of employment equity. This paper holds that in order to find out the issue of employment equity, the most important thing is to define what is fair, employment and employment equity, which determines the basic category of this study. Therefore, the first section of this chapter analyzes the three concepts. This paper holds that fairness is a kind of social equity based on mutual benefit and harmony. And its realization must be based on three basic principles, namely, the principles of entitlement, need and equality; employment is a broader concept that encompasses both the behaviour of workers in obtaining a job and the state of work after obtaining a job. Employment is not only limited to the employment behavior of enterprises, but also includes the employment behavior of all employers (including public institutions). The understanding of employment equity is based on the definition of equity and employment in this paper. It is a kind of basic human rights that the workers in the field of employment accord with the fair theory, need and the principle of equality. In the second section, the author distinguishes and analyzes the related concepts of employment equity, employment freedom and employment efficiency, and points out that although freedom and efficiency are very important, they can only be proved to be reasonable and necessary on the basis of fairness. The third chapter mainly demonstrates the function and role of market, government and rule of law in ensuring employment equity. The first section introduces the basic theory of market failure and points out that the unfair behavior of employment is an inevitable behavior and an important market failure. Then this paper demonstrates whether the market itself has the function of self-eliminating the unfair behavior of employment, and thinks that the function of the market is limited, which provides a certain understanding basis for the theme of the second section of this chapter-the government's intervention in the employment market. However, the second section, after analyzing the possible role of the government in detail, believes that although the government has a unique advantage over the market in ensuring employment equity, it also has defects in government protection. And in many cases, the government is even itself a maker of job inequality. The third section, based on the first two sections, demonstrates in detail the decisive role of the rule of law in ensuring employment equity, and points out several issues that should be paid attention to in the legal protection of employment equity, including the balance of interests between employers and workers. The effectiveness of the Employment Equity Protection Law and the Employment Equity Protection Law are analyzed.
