【摘要】： 勞資關(guān)系是一個博弈平衡的關(guān)系,每個時代都會賦予它不同的內(nèi)涵和外延。刑法介入勞動關(guān)系調(diào)整是社會經(jīng)濟發(fā)展到一定歷史階段的必然產(chǎn)物,是人類文明的標志。對勞動權(quán)利的可能被侵害程度、社會所有成員對勞動者勞動的尊重和認可程度直接關(guān)系到刑法所要調(diào)整的勞動關(guān)系的范圍。可以借鑒國外先進的勞動刑事立法的經(jīng)驗,填補我們國家勞動刑事立法的盲點和空白。經(jīng)濟體制改革,法律不斷地經(jīng)歷著時代的考驗,人與人之間的協(xié)調(diào)發(fā)展成為這個時代的最強烈的訴求。國家適當(dāng)擴大刑法對勞動法益的范圍和保護力度,是“科學(xué)發(fā)展觀”理念在執(zhí)政上的具體表現(xiàn),勞動刑法在中國的誕生和發(fā)展是時代的選擇,具有深遠的理論意義,更能順應(yīng)現(xiàn)實的發(fā)展的需要。嚴厲的勞動刑法彰顯出調(diào)和勞資關(guān)系矛盾的“以人為本”的理念。不間斷的勞動爭議出現(xiàn)的今天,我們更加呼吁勞動刑法出臺。
[Abstract]:The relationship between labor and capital is a balance of game, each time will give it different connotation and extension. The adjustment of labor relations in the criminal law is the inevitable product of the social and economic development to a certain historical stage. It is the symbol of human civilization. The extent to which the labor rights may be infringed on, and the respect and recognition of the labor of all the members of the society by all members of the society. The extent directly relates to the scope of labor relations that the criminal law should adjust. We can learn from the experience of advanced foreign labor criminal legislation to fill the blind spot and blank of our country's labor criminal legislation. The reform of the economic system has constantly experienced the test of the times, and the coordinated development between people and people has become the strongest in this era. The state should expand the scope and protection of the criminal law to the labor law properly. It is the concrete manifestation of the "Scientific Outlook on Development" concept in power. The birth and development of labor criminal law in China is the choice of the times. It has profound theoretical significance and can conform to the needs of the actual development. The strict labor criminal law shows the harmony of labor and capital. The concept of "people-oriented" is contradictory. Today, we continue to call for the introduction of the labor criminal law.
