兼職大學(xué)生勞動(dòng)權(quán)益的法律保護(hù)研究

【摘要】:隨著高校收費(fèi)體制的改革,大學(xué)生不再由國(guó)家提供全部學(xué)費(fèi)。對(duì)大多數(shù)家庭來說,培養(yǎng)一名大學(xué)生是一筆不小的開支。為了給家庭經(jīng)濟(jì)減負(fù),在校大學(xué)生紛紛走出校門,走上兼職崗位。同時(shí),大學(xué)生面臨的就業(yè)形勢(shì)日益嚴(yán)峻,而兼職可以獲取實(shí)踐經(jīng)驗(yàn)、贏得競(jìng)爭(zhēng)優(yōu)勢(shì),這也成為大學(xué)生選擇兼職的重要原因。但是,隨著大學(xué)生兼職現(xiàn)象逐漸普遍化,兼職大學(xué)生的勞動(dòng)權(quán)益屢遭侵犯,卻得不到有效救濟(jì)的情況開始廣受關(guān)注,各種圍繞兼職大學(xué)生展開的社會(huì)調(diào)查、訪問、輿論報(bào)道讓這一特殊群體的勞動(dòng)權(quán)益保障問題成為社會(huì)議論的熱點(diǎn)話題,保護(hù)兼職大學(xué)生勞動(dòng)權(quán)益勢(shì)在必行。 本文圍繞兼職大學(xué)生勞動(dòng)權(quán)益的保護(hù)問題展開研究。全文除引言外共分為五個(gè)部分: 第一部分通過介紹廣州洋快餐店涉嫌違規(guī)用工案,揭示出用人單位在使用兼職大學(xué)生這一勞動(dòng)力形式過程中主要存在的問題。 第二部分介紹了兼職大學(xué)生勞動(dòng)權(quán)益受損的基本現(xiàn)狀。在這一部分中,本文首先對(duì)大學(xué)生“實(shí)習(xí)”、“勤工助學(xué)”、“打工”等概念進(jìn)行了界定和說明,明確了本文使用的大學(xué)生“兼職”的涵義。然后介紹了兼職大學(xué)生勞動(dòng)權(quán)益受損的主要情形,包括工資報(bào)酬權(quán)難以保障、勞動(dòng)安全和自由權(quán)受侵害、無法享受社會(huì)保險(xiǎn)和福利權(quán)以及對(duì)企業(yè)及中介機(jī)構(gòu)的信賴?yán)媸芮趾Α?第三部分系統(tǒng)闡釋了兼職大學(xué)生勞動(dòng)權(quán)益保護(hù)面臨的理論爭(zhēng)議與制度障礙。論文首先針對(duì)大學(xué)生是否具有勞動(dòng)者身份和大學(xué)生兼職形成何種法律關(guān)系兩個(gè)理論爭(zhēng)議問題進(jìn)行分析。在對(duì)正反兩方觀點(diǎn)分別進(jìn)行評(píng)析的基礎(chǔ)上,筆者提出了自己的觀點(diǎn),即兼職大學(xué)生具有勞動(dòng)者的身份,大學(xué)生兼職形成的具體法律關(guān)系包括三種情況:可以成立勞動(dòng)關(guān)系,可能形成雇傭關(guān)系,有相當(dāng)一部分屬于非全日制用工。然后,論文從立法、執(zhí)法、仲裁與司法三個(gè)層面分析了兼職大學(xué)生勞動(dòng)權(quán)益保護(hù)存在的制度障礙。 第四部分介紹了美國(guó)、德國(guó)、法國(guó)、日本、英國(guó)等國(guó)家保護(hù)兼職大學(xué)生勞動(dòng)權(quán)益的概況,并總結(jié)出其中值得我國(guó)借鑒的地方。 第五部分提出了完善兼職大學(xué)生勞動(dòng)權(quán)益保護(hù)的法律途徑,以期對(duì)我國(guó)保護(hù)兼職大學(xué)生勞動(dòng)權(quán)益的制度完善有所啟發(fā)。首先根據(jù)兼職大學(xué)生形成的不同法律關(guān)系,可以適用現(xiàn)有規(guī)定的,就依照現(xiàn)有規(guī)定執(zhí)行;現(xiàn)有規(guī)定不足的應(yīng)當(dāng)完善相關(guān)制度,,包括確認(rèn)兼職大學(xué)生的勞動(dòng)者身份,賦予兼職大學(xué)生勞動(dòng)者的權(quán)利,完善兼職大學(xué)生的社會(huì)保險(xiǎn)制度、行為規(guī)范制度、社會(huì)服務(wù)制度和權(quán)利救濟(jì)制度等制度。
[Abstract]:With the reform of the charge system in Colleges and universities, college students are no longer provided with all tuition fees by the state. For most families, cultivating a college student is not a small expense. In order to reduce the family economy, college students go out of school and take part-time jobs. At the same time, the employment situation of college students is increasingly severe, and part-time jobs can be obtained. Taking practical experience and winning competitive advantage, it has also become an important reason for college students to choose part-time jobs. However, with the gradual popularization of part-time students' Part-time phenomenon, the labor rights and interests of part-time college students have been repeatedly infringed, but the situation of effective relief has begun to be widely concerned. The protection of labor rights and interests of this special group has become a hot topic of social discussion. It is imperative to protect the rights and interests of part-time college students.
This article focuses on the protection of part-time college students' labor rights and interests. Besides the introduction, the article is divided into five parts.
The first part, through the introduction of the suspected cases of illegal employment in the Guangzhou ocean fast food store, reveals the main problems in the process of using the part-time college students as a labor form.
The second part introduces the basic status of the labor rights and interests of part-time college students. In this part, this article first defines and explains the concepts of "Internship", "work study" and "working", clarifies the meaning of "part-time" of the college students in this article, and then introduces the damage of the labor rights and interests of part-time college students. The main situation, including the difficult to guarantee the right to wage remuneration, the infringement of the labor safety and freedom rights, the failure to enjoy social insurance and welfare rights, and the infringement of the trust interests of enterprises and intermediaries.
The third part systematically explains the theoretical and institutional obstacles facing the protection of labor rights and interests of part-time college students. Firstly, this paper analyzes two theoretical disputes about whether the college students have the status of workers and the legal relationship of College Students' part-time jobs. On the basis of the analysis of the positive and negative two sides, the author puts forward the author. The point of view is that the part-time college students have the identity of the workers, and the concrete legal relations of the part-time college students include three kinds of situations: the labor relations can be established, the employment relationship may be formed, and a considerable part of the part-time employment can be formed. Then, the thesis analyzes the part-time college students from the three levels of legislation, law enforcement, arbitration and judicature. Institutional barriers to the protection of labor rights and interests.
The fourth part introduces the general situation of protecting the labor rights and interests of part-time college students in the United States, Germany, France, Japan and the United Kingdom, and summarizes the places that deserve our reference.
The fifth part puts forward the legal way to improve the protection of the labor rights and interests of part-time college students, in order to enlighten the system of protecting the labor rights and interests of part-time college students in our country. First, according to the different legal relations formed by the part-time college students, the existing regulations can be applied, and the existing regulations should be implemented; the existing regulations should be perfected. The relevant systems include identifying the working status of part-time college students, giving part-time college students' rights, perfecting the social insurance system for part-time college students, the system of behavior norms, social service system and rights relief system.
