員工違規(guī)行為處分制度研究

【摘要】:2008年,隨著《企業(yè)職工獎(jiǎng)懲條例》的廢止,我國(guó)的法律規(guī)制中缺少對(duì)勞動(dòng)者違規(guī)行為處分的詳細(xì)規(guī)定,導(dǎo)致國(guó)有控股公司在處分違規(guī)行為時(shí)容易發(fā)生勞動(dòng)糾紛。關(guān)于勞動(dòng)者法律責(zé)任,在我國(guó)《勞動(dòng)合同法》規(guī)定中寥若星辰,故而違約責(zé)任主要從企業(yè)與勞動(dòng)者簽定的勞動(dòng)合同以及公司勞動(dòng)規(guī)章制度當(dāng)中體現(xiàn)。員工違規(guī)行為處分制度隸屬于勞動(dòng)規(guī)章制度,與國(guó)有控股公司經(jīng)營(yíng)管理權(quán)密不可分。本文以國(guó)有控股公司現(xiàn)行勞動(dòng)關(guān)系管理機(jī)制為切入點(diǎn),發(fā)現(xiàn)國(guó)有控股公司適用《勞動(dòng)法》及《勞動(dòng)合同法》的困惑,研究國(guó)有控股公司自行制定員工違規(guī)行為處分制度的必要性和可行性。首先從國(guó)有控股公司勞動(dòng)關(guān)系著手,以某廣電公司為重點(diǎn),對(duì)其員工涵蓋范圍、員工工作職責(zé)進(jìn)行了較為深入的調(diào)研。在梳理國(guó)有控股公司及其員工享有權(quán)利和義務(wù)的基礎(chǔ)上,分析國(guó)有控股公司勞動(dòng)關(guān)系法律特征。其次,深入探討國(guó)有控股公司違規(guī)處分制度的法律依據(jù),即在以主體合法、內(nèi)容合理合法以及程序合法的基礎(chǔ)之上制定的員工違規(guī)行為處分制度方具約束力。最后,提出國(guó)有控股公司處分權(quán)實(shí)施目的和實(shí)施原則,并且采用懲教相結(jié)合的方式,處分違反國(guó)有控股公司規(guī)定,導(dǎo)致公司名譽(yù)或經(jīng)濟(jì)損失的勞動(dòng)者。通過某廣電網(wǎng)絡(luò)公司實(shí)施員工違規(guī)行為處分制度后給經(jīng)營(yíng)管理帶來的積極作用,體現(xiàn)此次研究課題的重要意義。同時(shí),就某廣電網(wǎng)絡(luò)公司實(shí)施員工違規(guī)行為處分制度實(shí)踐中發(fā)現(xiàn)的典型問題,就如何完善國(guó)有控股公司經(jīng)營(yíng)管理提出一些建議,以更好地為國(guó)有控股公司行使違規(guī)處分權(quán)提供一些幫助。
[Abstract]:In 2008, with the abolition of "regulations on reward and punishment of Enterprise Workers", the detailed provisions on the punishment of illegal behaviors of workers are lacking in the legal regulations of our country, which leads to labor disputes that occur easily when the state-owned holding companies deal with violations of regulations. About laborer's legal liability, in our country "Labor contract Law", the liability for breach of contract is mainly reflected in the labor contract signed by the enterprise and the laborer as well as the company's labor rules and regulations. The punishment system of employee's illegal behavior belongs to the labor rules and regulations, and is closely related to the management power of the state-owned holding company. Based on the current labor relations management mechanism of state-owned holding companies, this paper finds that the state-owned holding companies are puzzled by the application of the Labor Law and the Labor contract Law. To study the necessity and feasibility of the state-owned holding company to formulate the system of staff violation. First, starting from the labor relations of state-owned holding company, focusing on a radio and television company, the author makes a deep investigation on the scope of staff coverage and the work responsibilities of employees. On the basis of combing the rights and obligations of the state-owned holding companies and their employees, this paper analyzes the legal characteristics of the labor relations of the state-owned holding companies. Secondly, the author probes into the legal basis of the illegal punishment system of state-owned holding company, that is, on the basis of the legality of the subject, the reasonable content and the lawful procedure, it is binding to establish the system of the illegal punishment of the employee. At last, the author puts forward the purpose and principle of the punishment right of the state-owned holding company, and adopts the method of combining correction to punish the laborers who violate the regulations of the state-owned holding company and cause the company's reputation or economic loss. Through a radio and television company to carry out the staff illegal behavior punishment system to bring the positive function to the management, manifests this research topic important significance. At the same time, some suggestions on how to perfect the management of state-owned holding company are put forward in view of the typical problems found in the practice of a radio and television network company implementing the system of disobeying employees' illegal behavior. In order to better state-holding companies to exercise the right to violate the penalty to provide some help.
