無(wú)錫市人事仲裁工作的實(shí)踐與思考

【摘要】:正 一、無(wú)錫市人事爭(zhēng)議仲裁管理初見成效 為加強(qiáng)無(wú)錫市人事爭(zhēng)議仲裁工作的開展,無(wú)錫市人事局在《勞動(dòng)法》、《江蘇省人才流動(dòng)管理暫行條例》的基礎(chǔ)上,制訂了《無(wú)錫市人才流動(dòng)爭(zhēng)議仲裁暫行辦法》及其實(shí)施細(xì)則,建立了人才流動(dòng)爭(zhēng)議仲裁委員會(huì)和一支相應(yīng)的仲裁隊(duì)伍。人才流動(dòng)中因辭職、辭退或違紀(jì)處理以及連帶住房、培訓(xùn)費(fèi)等財(cái)產(chǎn)問(wèn)題、合同管理中的違約責(zé)任糾紛等比較多,兩者約占案例總數(shù)的80%以上。這些糾紛絕大部分在單位內(nèi)部就可以解決,但也有當(dāng)事人自身無(wú)法處理的,只能通過(guò)上級(jí)仲裁機(jī)構(gòu)調(diào)解或仲裁,甚至向法院起訴。對(duì)此,無(wú)錫市人才流動(dòng)爭(zhēng)議仲裁機(jī)構(gòu)堅(jiān)持做到:一搞好宣傳教育,通過(guò)媒體宣傳和接待來(lái)信來(lái)訪開展政策咨詢與教育工作,防患于未然;二注重調(diào)解,先后妥善解決了上千例人才流動(dòng)糾紛,如:無(wú)錫市波紋管廠在一次公開招聘
