【摘要】：自2012年起,我國(guó)開始推行以現(xiàn)代學(xué)徒制為核心的技能人才培養(yǎng)模式,學(xué)徒則是該模式的基礎(chǔ)概念。然而,當(dāng)前我國(guó)法律上學(xué)徒的指代對(duì)象過多,涉及的法律關(guān)系復(fù)雜�；A(chǔ)概念不明使得判斷前提無法明確,概念的泛用增加了司法的難度,同時(shí)也缺乏有效的利益平衡�？v觀域外成功推行學(xué)徒制的國(guó)家,都將學(xué)徒納入勞動(dòng)法的保護(hù)范圍,概念明確、外延清晰。因此,應(yīng)當(dāng)厘定我國(guó)學(xué)徒的身份,將其納入勞動(dòng)法的保護(hù)范圍;建立相應(yīng)的規(guī)范制度,實(shí)現(xiàn)勞資兩利。
[Abstract]:Since 2012, China began to implement the modern apprenticeship system as the core of the training model of skilled personnel, apprenticeship is the basic concept of this model. However, there are too many reference objects for apprenticeship in our country, and the legal relationship is complicated. Because the basic concept is unclear, the premise of judgment is not clear, the universal application of the concept increases the difficulty of judicature, and it also lacks the effective balance of interests. Throughout the successful implementation of apprenticeship abroad countries, apprenticeships are included in the scope of labor law protection, clear concept, clear extension. Therefore, we should define the status of apprenticeship in our country and bring it into the protection scope of labor law, and establish the corresponding normative system to realize the interests of labor and management.
