【摘要】：改革開放以來,伴隨著我國城鎮(zhèn)化及工業(yè)化的快速發(fā)展,城鎮(zhèn)中對(duì)勞動(dòng)力的需求日益增加,特別是一線生產(chǎn)員工的需求,與此同時(shí),大批農(nóng)村剩余勞動(dòng)力(多數(shù)為農(nóng)民工)因生活壓力而涌向城鎮(zhèn)尋求出路,農(nóng)民工的大量出現(xiàn),不但緩解了城鎮(zhèn)中勞動(dòng)力緊缺的問題,也解決了農(nóng)村中剩余勞動(dòng)力的問題,在加快城鎮(zhèn)建設(shè)快速發(fā)展的同時(shí),也促進(jìn)了農(nóng)村經(jīng)濟(jì)的發(fā)展。但是,由于農(nóng)民工受教育程度不高以及各方面客觀條件的限制,進(jìn)城的農(nóng)民工多集中在建筑業(yè)、制造業(yè)等勞動(dòng)密集型的行業(yè),工作時(shí)間長、工作強(qiáng)度高、工作環(huán)境差、缺少必要的勞動(dòng)保護(hù)條件及安全保障措施使得農(nóng)民工成為工傷事故及職業(yè)病的高危人群。農(nóng)民工在工傷事故發(fā)生后未及時(shí)獲得賠償或未獲得賠償下而導(dǎo)致其他惡性傷害案件時(shí)有發(fā)生,隨著社會(huì)的不斷發(fā)展與進(jìn)步,農(nóng)民工工傷保險(xiǎn)問題已成為了當(dāng)今社會(huì)及普通民眾普遍關(guān)心的社會(huì)問題,及時(shí)有效的解決農(nóng)民工的工傷保險(xiǎn)中存在的問題,不但是保護(hù)農(nóng)民工合法權(quán)益的需要,也是構(gòu)建穩(wěn)定、和諧社會(huì)的需要。珠三角地區(qū)作為廣東經(jīng)濟(jì)發(fā)達(dá)的地區(qū)之一,民營、私企業(yè)眾多,且多為勞動(dòng)密集型的、工傷發(fā)生率較高的加工制造業(yè)及建筑行業(yè)等,相對(duì)于外資企業(yè)、國有企業(yè)而言,民營企業(yè)、私營企業(yè)對(duì)于工人的文化程度要求不高、入職門檻較低且需求量較大,因此吸引了大批的農(nóng)民工到該地謀生、就業(yè);多數(shù)民營、私營企業(yè)在生產(chǎn)中往往只注重追求利潤的最大化,而忽略對(duì)農(nóng)民工工傷預(yù)防、安全生產(chǎn)等合法權(quán)益的保護(hù),同時(shí),農(nóng)民工因文化程度不高,對(duì)所從事崗位的職業(yè)危險(xiǎn)性認(rèn)識(shí)不足,在日常的工作中常常缺乏自我保護(hù)及安全防護(hù)的意識(shí),因此工傷事故的發(fā)生率一直較高,農(nóng)民工的合法權(quán)益受到的極大的侵害。本文通過將典型的工傷案件與工傷保險(xiǎn)基礎(chǔ)理論及相關(guān)法律制度相結(jié)合的方式分析了目前廣東珠三角地區(qū)農(nóng)民工工傷保險(xiǎn)存在的問題。在緒論中,介紹了本文的研究背景、研究的意義、研究的方法及目前國內(nèi)外對(duì)農(nóng)民工工傷保險(xiǎn)問題的研究現(xiàn)狀等;第1章是對(duì)與農(nóng)民工傷保險(xiǎn)相關(guān)的基礎(chǔ)理論的研究;第2章主要是對(duì)廣東珠三角地區(qū)農(nóng)民工工傷保險(xiǎn)存在的問題及原因進(jìn)行研究、分析;第3章主要是對(duì)完善廣東珠三角地區(qū)工區(qū)農(nóng)民工工傷保險(xiǎn)提出相關(guān)建議。
[Abstract]:Since the reform and opening up, with the rapid development of urbanization and industrialization in China, the demand for labor in cities and towns is increasing day by day, especially the demand for front-line production staff, at the same time, A large number of rural surplus labors (most of them are migrant workers) are flocking to cities and towns to find a way out because of the pressure of life. The emergence of a large number of migrant workers not only alleviates the shortage of labor in towns, but also solves the problem of surplus labor in rural areas. In accelerating the rapid development of urban construction, but also to promote the development of rural economy. However, due to the low level of education of migrant workers and the restrictions of various objective conditions, migrant workers entering the city are mostly concentrated in labor-intensive industries such as construction and manufacturing industries, with long working hours, high working intensity, and poor working environment. Lack of necessary labor protection conditions and safety measures make migrant workers become high risk groups of industrial accidents and occupational diseases. With the development and progress of the society, the migrant workers have not been compensated in time or have not been compensated after the industrial accidents, which lead to other malignant injury cases occur from time to time. The problem of migrant workers' industrial injury insurance has become a social problem that is of general concern to the society and ordinary people. To solve the problems in the industrial injury insurance of migrant workers in a timely and effective manner is not only the need to protect the legitimate rights and interests of migrant workers, but also the construction of stability. The need of a harmonious society. As one of the economically developed areas in Guangdong, the Pearl River Delta region has a large number of private and private enterprises, and most of them are labor-intensive, processing, manufacturing and construction industries with a high incidence of work-related injuries. Compared with foreign-funded enterprises, state-owned enterprises, A private enterprise has a low level of education for its workers, a low entry threshold and a high demand, thus attracting a large number of migrant workers to work there for a living. In production, private enterprises only pay attention to the maximization of profits, while neglecting the protection of the legitimate rights and interests of migrant workers, such as industrial injury prevention, safety in production, etc. At the same time, migrant workers have a low level of education. There is a lack of awareness of the occupational hazards of the posts engaged in, and a lack of awareness of self-protection and safety protection in the daily work. Therefore, the incidence of industrial accidents has been high, and the legitimate rights and interests of migrant workers have been greatly infringed. By combining the typical industrial injury cases with the basic theory of industrial injury insurance and the relevant legal system, this paper analyzes the problems existing in the industrial injury insurance of migrant workers in the Pearl River Delta region of Guangdong Province. In the introduction, this paper introduces the research background, significance, research methods and the current research situation of migrant workers' industrial injury insurance at home and abroad. The second chapter is mainly to study the problems and causes of migrant workers' industrial injury insurance in the Pearl River Delta area of Guangdong Province, and the third chapter is to put forward the relevant suggestions to improve the industrial injury insurance of migrant workers in the Pearl River Delta area of Guangdong Province.
