【摘要】：從2004年，國務院提出開展安全質量標準化活動的要求，到2011年開啟了全面推進企業(yè)安全生產標準化建設的序幕，我國企業(yè)安全生產標準化建設已有8個年頭。寧波市企業(yè)安全生產標準化建設工作從2005年起步，2011年寧波市與沈陽市、廣州市、山東諸城市以及北京市順義區(qū)一同被列為全國安全生產標準化建設示范城市，相關工作推進速度不斷加快。但迄今為止，我國還沒有專門規(guī)范企業(yè)安全生產標準化建設的成文法，總體來講，企業(yè)安全生產標準化建設是摸著石頭過河，先有實踐的推進，后有具體的工作指導政策，尤其是法律法規(guī)的缺失使得此項工作在開展過程中出現了很多問題。 本文以寧波市為例，基于我國企業(yè)安全生產標準化建設立法現狀，通過分析企業(yè)安全生產標準化建設的作用及存在問題，圍繞正在寧波市進行的《寧波市企業(yè)安全生產標準化建設條例》這一地方立法調研項目，從梳理寧波市安全生產企業(yè)標準化建設立法需求入手，，針對若干企業(yè)安全生產標準化建設過程中出現的問題，分析國內外企業(yè)安全生產標準化建設過程中的經驗做法，明確寧波市相關地方立法主要制度建構和重點內容，在論述分析的基礎上擬制了《寧波市企業(yè)安全生產標準化建設條例（草案）》。主要內容分述如下： 首先，指出了我國目前尚未出臺企業(yè)安全生產標準化專門法律法規(guī)的立法現狀。 然后，對企業(yè)安全生產標準化概念及其發(fā)展的進行簡介，分析了企業(yè)安全生產標準化建設的作用、現狀及出現的突出問題，指出對此立法的必要性和緊迫性。 接著，是企業(yè)安全生產標準化立法的定位問題。主要分析了四個方面內容:一是分析企業(yè)安全生產標準化立法在整個安全生產法律法規(guī)體系中的位置；二是分析了企業(yè)安全生產標準化主要立法路徑，通過對比分析，得出了通過地方立法“先行先試”，然后再由國家集中統一立法的最優(yōu)路徑；三是總結分析了寧波市、其他地區(qū)企業(yè)安全生產標準化的經驗做法及國外發(fā)達國家安全生產方面的先進經驗和有效做法，作為立法的借鑒；四是在上述分析的基礎上指出了這一路徑將會出現的主要問題并提出處理辦法。 最后，本文在前面論證分析的基礎上，以寧波市正在進行了企業(yè)安全生產標準化立法調研項目為例，提出了立法主要制度建構和重點內容。主要分三個部分內容：一是提出了企業(yè)安全生產標準化立法的總體目標、指導思想和立法原則；二是對企業(yè)安全生產標準化三大法律關系主體進行分析；三是通過對違法行為的分析，依據《安全生產法》及其他法律法規(guī)規(guī)定，初步確定了企業(yè)安全生產標準化建設立法的法律責任。
[Abstract]:From 2004, the State Council put forward the requirements for carrying out the standardization of safety quality activities. By 2011, it opened the prelude to the construction of standardized construction of enterprise safety production. The construction of standardized safety production for enterprises in China has 8 years. The construction of standardization construction of Ningbo enterprise safety production started in 2005, Ningbo and Shenyang in 2011, Guangzhou in 2011. City, Shandong city and Shunyi District of Beijing are listed as the demonstration city of national safety production standardization, and the speed of related work is speeding up. But up to now, our country has not specially standardized the written law of the standardization construction of enterprise safety production. In general, the construction of enterprise safety production standardization is crossing the river. First of all, there are practical policies, especially the lack of laws and regulations.
Taking Ningbo as an example, based on the legislative status of the standardization construction of enterprise safety production in China, by analyzing the role and existing problems of the construction of the standardization of enterprise safety production, this paper focuses on the construction regulations of the standardization construction of the safety production of Ningbo enterprises, which is carried out in the city of Ningbo, and combs the safety production enterprises in Ningbo. According to the requirements of the standardization of the construction of the industry, in view of the problems arising in the construction process of the standardization of the safety production of some enterprises, this paper analyzes the experience and practice in the process of the construction of the standardization of enterprise safety production at home and abroad, and makes clear the main system construction and key content of the relevant local legislation in Ningbo. On the basis of the analysis, the "Ningbo enterprise" is made. The regulations on safety production standardization (Draft) are more than.
First of all, it is pointed out that China has not yet introduced the legislation status of the specialized laws and regulations on safety production standardization.
Then, the concept of enterprise safety production standardization and its development are briefly introduced, the role of the construction of standardization of enterprise safety production, the present situation and the outstanding problems are analyzed, and the necessity and urgency of the legislation are pointed out.
Then, it is the positioning problem of the standardization legislation of enterprise safety production. It mainly analyzes four aspects: one is the analysis of the position of the legislation of the standardization of enterprise safety production standardization in the whole law and law system of safety production; the two is the analysis of the main legislative path of the standardization of the enterprise safety production standardization, and through the comparative analysis, the local legislation is obtained. "First try", and then the state centralized and unified the optimal path of the legislation; three is a summary and analysis of Ningbo, other areas of the experience of enterprise safety production standardization and the advanced experience and effective practice of foreign developed countries, as a reference for legislation; four is on the basis of the above analysis points out this First, the main problems that will arise in the path and propose solutions.
Finally, on the basis of the preceding demonstration and analysis, this article takes Ningbo city as an example of the legislative research project on the standardization of enterprise safety production, and puts forward the main system construction and key content of the legislation. The main contents are divided into three parts: first, the general objective of the legislation of the standardization of enterprise safety production, the guiding ideology and the legislative principles are put forward. The two is the analysis of the three major legal relations subject to the standardization of enterprise safety production. Three, through the analysis of illegal activities, according to the provisions of the "safety production law" and other laws and regulations, the legal responsibility of the construction legislation of the enterprise safety production standardization is preliminarily determined.
