域外法中就業(yè)平等權(quán)研究

【摘要】:目前,就業(yè)作為社會(huì)問(wèn)題的重要一環(huán),已經(jīng)成為解決社會(huì)問(wèn)題的關(guān)鍵,同時(shí)也是公民自由全面發(fā)展的關(guān)鍵。平等的就業(yè)競(jìng)爭(zhēng)權(quán),是民主權(quán)利的重要內(nèi)涵,也是國(guó)家發(fā)展經(jīng)濟(jì)的一項(xiàng)重要內(nèi)容。維護(hù)就業(yè)平等權(quán),具有重要意義:它反應(yīng)了現(xiàn)代民主的重要內(nèi)容,為社會(huì)經(jīng)濟(jì)發(fā)展提供高素質(zhì)勞動(dòng)力,為人的生存發(fā)展提供動(dòng)力,在全社會(huì)促進(jìn)形成公平競(jìng)爭(zhēng)的意識(shí)。本文第一部分重點(diǎn)介紹了就業(yè)平等權(quán)的主要內(nèi)涵及價(jià)值。在本文中,將就業(yè)分為了三個(gè)階段,一是就業(yè)資格獲得階段,二是參與就業(yè)競(jìng)爭(zhēng)的階段,三是就業(yè)勞動(dòng)階段。在這三個(gè)階段當(dāng)中,就業(yè)平等權(quán)可以理解為以下三個(gè)方面:機(jī)會(huì)平等、資源平等與非歧視。第二部分,在本文中,大量篇幅對(duì)國(guó)際上以及美國(guó)、英國(guó)的就業(yè)平等權(quán)的法制化過(guò)程做出了非常深入的分析并進(jìn)行了比較,并將域外國(guó)家其他法律形式進(jìn)行了歸納梳理,國(guó)際法上部分條約作為維護(hù)就業(yè)平等權(quán)的基礎(chǔ)性條約也做了分析介紹,并總結(jié)出值得我國(guó)所借鑒的經(jīng)驗(yàn):逐步的法治化進(jìn)程、舉證責(zé)任的合理分配以及專業(yè)執(zhí)法機(jī)構(gòu)的設(shè)立。最后一部分,由于中國(guó)部分立法《勞動(dòng)法》及《民事訴訟法》的缺陷導(dǎo)致就業(yè)平等權(quán)的行使產(chǎn)生障礙,形式上的就業(yè)平等無(wú)法滿足公民自身的就業(yè)需要,實(shí)質(zhì)上的就業(yè)平等才正是應(yīng)當(dāng)實(shí)現(xiàn)的。因此針對(duì)此問(wèn)題要從實(shí)體法和程序法入手,完善《勞動(dòng)法》中適用主體、勞動(dòng)關(guān)系以及對(duì)競(jìng)業(yè)禁止的規(guī)定,對(duì)《民事訴訟法》中關(guān)于勞動(dòng)爭(zhēng)議救濟(jì)程序逐步完善,使得每一位公民都應(yīng)平等地享有此項(xiàng)權(quán)利,不僅僅是為了獲得生存所需要的物質(zhì)利益,也是為了實(shí)現(xiàn)公民自身的社會(huì)價(jià)值。
[Abstract]:At present, as an important part of social problems, employment has become the key to solve social problems, and also the key to the free and all-round development of citizens. Equal right to competition in employment is an important connotation of democratic rights and an important part of national economic development. It is of great significance to safeguard the equal right of employment: it reflects the important content of modern democracy, provides high quality labor force for social and economic development, provides motive force for human survival and development, and promotes the formation of fair competition consciousness in the whole society. The first part of this paper mainly introduces the main connotation and value of the right to equality of employment. In this paper, employment is divided into three stages, one is the stage of obtaining employment qualification, the other is the stage of participating in the employment competition, and the third is the stage of employment. In these three stages, the right to employment equality can be understood as the following three aspects: equality of opportunity, equality of resources and non-discrimination. The second part, in this paper, a large number of pages on the international and the United States, the United Kingdom, the process of employment equality of the legal process made a very in-depth analysis and comparison, and foreign countries of other legal forms are summarized and combed. Some treaties in international law, as the basic treaties to safeguard the equal right to employment, are also analyzed and introduced, and the experiences that our country can learn from them are summarized: the gradual process of rule of law, the reasonable distribution of the burden of proof and the establishment of professional law enforcement agencies. In the last part, due to the defects of some Chinese legislation and the Civil procedure Law, there are obstacles to the exercise of the right to equality of employment, and the formal equality of employment cannot meet the employment needs of citizens themselves. In essence, employment equality should be realized. Therefore, to solve this problem, we should start with substantive law and procedural law, perfect the applicable subject, the labor relations and the prohibition of non-competition in the Labor Law, and gradually perfect the relief procedure of labor dispute in the Civil procedure Law. So that every citizen should enjoy this right on an equal footing, not only for the material benefit needed for survival, but also for the realization of the citizen's own social value.
