職場性騷擾的法律規(guī)制研究

【摘要】:職場性騷擾問題是現(xiàn)今世界各國普遍存在的社會問題。從我國的情況來看,隨著人們權(quán)利意識的提高,職場性騷擾問題逐漸成為人們關(guān)注的話題。近年來,發(fā)生職場性騷擾的案件越來越多,得到社會各界的廣泛討論與關(guān)注。然而,由于我國相關(guān)立法在規(guī)定職場性騷擾方面存在不完善的問題,審判實踐中法官面臨著對待職場性騷擾問題時認識不一、法律適用標準難以統(tǒng)一等難題。為了解決職場性騷擾問題,為審判實踐提供更充足的理論支持,我們應(yīng)該在認清國情的情況下,積極借鑒外國先進立法經(jīng)驗,加快立法步伐,豐富我國相關(guān)法律,努力保護受害者的利益,以便能夠有效地維護正常的職場秩序和社會的和諧穩(wěn)定,促進社會良好和諧發(fā)展。本文正是從這一視角出發(fā),試圖通過對職場性騷擾的若干問題規(guī)制研究,并對此問題提出一些完善的建議,以期望對此類案件的處理提供一點有用意見。 本文除前言、結(jié)語外共分為以下四個部分: 第一部分是問題的提出。本部分主要簡單介紹一個案例,并對案例引發(fā)的問題進行梳理。主要涉及的問題是:規(guī)制職場性騷擾的必要性是什么?職場性騷擾如何界定?職場性騷擾的責任承擔者是誰? 第二部分是規(guī)制職場性騷擾的必要性。這部分主要從三個方面來說明規(guī)制職場性騷擾的必要性和現(xiàn)實意義。 第三部分是職場性騷擾的概念界定。這部分首先從四個方面進行分析,以期說明職場性騷擾的概念,然后分析職場性騷擾的法律特征。最后對職場性騷擾進行分類,目的是為了下面部分找到我國解決職場性騷擾問題的方法。 第四部分是職場性騷擾的法律責任。本部分是該論文的重點,針對案例所反映的問題來分析和解決。其基本結(jié)構(gòu)是首先明確職場性騷擾行為人的責任承擔以及責任承擔方式,然后介紹國內(nèi)外關(guān)于雇主責任的相關(guān)立法情況,找出適合建立中國國情的雇主責任的方法,為了更好的保護受害者,對我國的建立雇主責任提出一些建議。
[Abstract]:Workplace sexual harassment is a common social problem all over the world. From the point of view of our country, with the improvement of people's awareness of rights, the issue of sexual harassment in the workplace has gradually become a topic of concern. In recent years, there are more and more cases of sexual harassment in the workplace. However, due to the imperfect regulation of workplace sexual harassment in the relevant legislation of our country, judges are faced with different understanding of the issue of sexual harassment in the workplace in trial practice and difficult to unify the applicable standards of the law. In order to solve the problem of sexual harassment in the workplace and provide more adequate theoretical support for the trial practice, we should actively learn from the advanced legislative experience of foreign countries and enrich the relevant laws of our country under the condition of clearly understanding the national conditions. Efforts to protect the interests of victims, in order to effectively maintain normal workplace order and social harmony and stability, promote social harmony and development. From this point of view, this paper attempts to study some problems of sexual harassment in the workplace, and puts forward some perfect suggestions in order to provide some useful suggestions on how to deal with such cases. In addition to the preface, the conclusion is divided into the following four parts: The first part is the proposal of the problem. This part mainly introduces a case and combs the problems caused by the case. The main questions involved are: what is the necessity of regulating sexual harassment in the workplace? What is the definition of sexual harassment in the workplace? Who is responsible for sexual harassment in the workplace? The second part is the necessity of regulating sexual harassment in the workplace. This part mainly from three aspects to explain the necessity and practical significance of regulation of sexual harassment in the workplace. The third part is the definition of workplace sexual harassment. This part first analyzes the concept of workplace sexual harassment from four aspects, and then analyzes the legal characteristics of workplace sexual harassment. Finally, the classification of workplace sexual harassment, the purpose is to find a solution to the problem of workplace sexual harassment in the following part. The fourth part is the legal liability of sexual harassment in the workplace. This part is the focus of this paper, to analyze and solve the problems reflected in the case. The basic structure is to first clarify the responsibility of the perpetrators of sexual harassment in the workplace and the way to assume the responsibility, and then introduce the relevant legislation on employer liability at home and abroad, and find out the appropriate ways to establish the employer liability in China. In order to better protect the victims, some suggestions on establishing employer responsibility in our country are put forward.
