【摘要】:勞動(dòng)關(guān)系是當(dāng)今社會(huì)經(jīng)濟(jì)關(guān)系中最重要的關(guān)系之一,勞動(dòng)關(guān)系問題不單單是經(jīng)濟(jì)和社會(huì)問題,也有可能轉(zhuǎn)化為政治問題。勞動(dòng)關(guān)系是否穩(wěn)定直接影響著社會(huì)經(jīng)濟(jì)中其他各類關(guān)系的和諧與穩(wěn)定。中國目前處于社會(huì)主義初級(jí)階段,勞動(dòng)力市場(chǎng)供給大于需求,勞動(dòng)者的地位明顯低于資本所有者的地位,資強(qiáng)勞弱的狀況普遍存在。 據(jù)統(tǒng)計(jì),自1995年《中華人民共和國勞動(dòng)法》頒布實(shí)施以來,中國的勞動(dòng)爭(zhēng)議呈現(xiàn)出不斷上升的趨勢(shì)。勞動(dòng)爭(zhēng)議數(shù)量增加的原因主要是中國在體制轉(zhuǎn)軌過程中,勞動(dòng)法律的過于粗線條、勞動(dòng)爭(zhēng)議仲裁的制度缺陷、勞動(dòng)監(jiān)察力度的薄弱以及社會(huì)保障制度的不完善,使得勞動(dòng)者利益經(jīng)常受損,成為體制改革成本的被轉(zhuǎn)嫁者,并進(jìn)而導(dǎo)致了勞資矛盾的激化和勞動(dòng)爭(zhēng)議數(shù)量的急劇攀升。 西方學(xué)者從不同的立場(chǎng)和理念出發(fā),對(duì)勞動(dòng)關(guān)系進(jìn)行研究,得出了各不相同的結(jié)論,形成了比較有代表性的五大理論學(xué)派,按照政治趨向上的保守到激進(jìn)的順序排列為:新保守學(xué)派、管理主義學(xué)派、正統(tǒng)多元論學(xué)派、自由改革主義學(xué)派和激進(jìn)學(xué)派。本文主要對(duì)該五大學(xué)派實(shí)踐典型國家的勞動(dòng)調(diào)節(jié)機(jī)制進(jìn)行比較研究,著重分析各國勞動(dòng)關(guān)系主體地位、勞動(dòng)調(diào)節(jié)模式、集體談判制度和勞動(dòng)爭(zhēng)議處理等方面。借鑒發(fā)達(dá)國家的經(jīng)驗(yàn)教訓(xùn),結(jié)合我國勞動(dòng)關(guān)系中存在的問題,提出解決現(xiàn)階段勞動(dòng)關(guān)系問題的有效制度——三方協(xié)商機(jī)制,并對(duì)建立健全三方協(xié)商機(jī)制提出合理化建議。
[Abstract]:Labor relationship is one of the most important relations in social and economic relations. The problem of labor relations is not only an economic and social problem, but also a political one. Whether the labor relationship is stable or not directly affects the harmony and stability of other kinds of relations in the social economy. At present, China is in the primary stage of socialism, the supply of labor market is larger than demand, and the position of labor is obviously lower than that of capital owner. According to statistics, since the promulgation and implementation of the Labor Law of the people's Republic of China in 1995, labor disputes in China have been on the rise. The main reasons for the increase in the number of labor disputes are that in the process of system transition in China, the labor law is too rough, the system of labor dispute arbitration is defective, the intensity of labor supervision is weak, and the social security system is not perfect. The interests of workers are often damaged and become the transferee of the cost of system reform, which leads to the intensification of labor conflicts and the sharp increase of the number of labor disputes. From different standpoint and concept, western scholars have studied labor relations, drawn different conclusions, and formed five representative schools of theory. According to the order of conservatism to radicalism in the political trend, they are neo-conservative school, managementist school, orthodox pluralistic school, liberal reformist school and radical school. This paper makes a comparative study on the labor regulation mechanism of the five schools of thought in the typical countries, focusing on the analysis of the main position of labor relations, the mode of labor regulation, the system of collective bargaining and the handling of labor disputes in various countries. Using the experience and lessons of developed countries for reference, combined with the existing problems in China's labor relations, this paper puts forward an effective system-tripartite consultation mechanism for solving the problems of labor relations at present, and puts forward some reasonable suggestions for establishing and perfecting the tripartite consultation mechanism.
