【摘要】: 在法律允許的范圍內(nèi),雇用他人從事某項(xiàng)工作已成為現(xiàn)代社會(huì)的一個(gè)顯著特點(diǎn)。然而,隨之而來(lái)的一個(gè)問(wèn)題便是:受雇人在完成工作的過(guò)程中,由于故意或過(guò)失而損害他人的合法權(quán)益時(shí)的責(zé)任承擔(dān),以及受雇人自身受害時(shí)的責(zé)任分配。雇主與雇員的賠償責(zé)任是一個(gè)十分重要的問(wèn)題,它不僅關(guān)系到社會(huì)經(jīng)濟(jì)秩序的穩(wěn)定,而且直接涉及到人們的財(cái)產(chǎn)和人身安全,因此完備的法律制度應(yīng)當(dāng)對(duì)此做出詳細(xì)的規(guī)定。除了傳統(tǒng)的勞動(dòng)法調(diào)整領(lǐng)域內(nèi)的雇用現(xiàn)象外,在民事活動(dòng)領(lǐng)域內(nèi)為了完成某項(xiàng)任務(wù)而短期地雇用他人的現(xiàn)象也普遍存在,比如說(shuō)請(qǐng)個(gè)幫工、雇個(gè)保姆等。勞動(dòng)法領(lǐng)域及民事領(lǐng)域的雇用都屬于廣義上的雇傭,但雇用關(guān)系的特征有著明顯的差異,在我國(guó)用以規(guī)制的法律也不同,分別由勞動(dòng)法和民法加以調(diào)解。目前國(guó)內(nèi)針對(duì)民事關(guān)系中的雇主責(zé)任和勞動(dòng)關(guān)系上的雇主責(zé)任的研究往往不加以區(qū)分,混雜論述,加之立法的不完善,以至于在責(zé)任認(rèn)定、歸責(zé)原則等有關(guān)問(wèn)題上界定模糊。分清不同情形下雇主所應(yīng)承擔(dān)的責(zé)任已成了一個(gè)不可回避的問(wèn)題。 本文對(duì)勞動(dòng)關(guān)系和勞務(wù)關(guān)系中雇主的對(duì)內(nèi)對(duì)外責(zé)任以比較的方法加以論述,力求使有關(guān)雇主責(zé)任的制度構(gòu)架更為清晰,同時(shí)也為實(shí)踐中的雇主責(zé)任問(wèn)題的解決提供方便。全文共分三大部分。第一部分介紹了雇主的分類,根據(jù)雇用關(guān)系的主體不同,分為勞動(dòng)關(guān)系中的雇主和民事勞務(wù)關(guān)系中的雇主,并分別介紹其范圍及特征。第二部分采用對(duì)比的方法介紹了雇主的對(duì)外責(zé)任,包括勞動(dòng)關(guān)系中雇主對(duì)第三人的責(zé)任和勞務(wù)關(guān)系中雇主對(duì)第三人的責(zé)任,著重分析介紹了雇主責(zé)任的理論基礎(chǔ)、構(gòu)成要件和歸責(zé)原則等。第三部分介紹了雇主的對(duì)內(nèi)責(zé)任,即勞動(dòng)關(guān)系中雇主對(duì)雇員的工傷責(zé)任和勞務(wù)關(guān)系中雇主對(duì)雇員受害的賠償責(zé)任。 總之,雇主責(zé)任問(wèn)題既是一個(gè)復(fù)雜的理論問(wèn)題,又是一個(gè)實(shí)踐問(wèn)題。本文主張?jiān)谖覈?guó)建立完善的雇主責(zé)任制度,合理地確定雇主雇員責(zé)任分配時(shí)所采用的歸責(zé)原則,衡平雇主、雇員及受害人之間的利益,以適應(yīng)雇主責(zé)任擴(kuò)大化的需要。值此民法典制訂之際,,借鑒國(guó)外的立法經(jīng)驗(yàn),結(jié)合我國(guó)具體情況,建立雇主責(zé)任制度已是立法所趨。
[Abstract]:To the extent permitted by law, the employment of others in a given work has become a distinct feature of modern society. Liability for damage to the legitimate rights and interests of others as a result of intent or negligence, as well as the distribution of liability when the employee himself is victimized. The liability of the employer and the employee is a very important issue, which is not only related to the stability of the social and economic order, And it is directly related to people's property and personal security, so the perfect legal system should make detailed provisions on this. In addition to the employment phenomenon in the field of traditional labor law adjustment, It is also common in the field of civil affairs to hire others for a short period of time in order to accomplish a certain task, such as hiring a helper, hiring a babysitter, etc. Employment in the field of labor law and in the field of civil affairs all belong to the broad sense of employment. However, the characteristics of the employment relationship are obviously different, and the laws used to regulate the employment relationship are also different in our country. The current domestic research on employer's responsibility in civil relations and employer's responsibility in labor relations is often not distinguished, mixed discussion, coupled with imperfect legislation, so that the responsibility of the identification, The definition of liability principle and other related issues is vague. It has become an unavoidable problem to distinguish the responsibility of the employer under different circumstances. This paper discusses the employer's responsibility to the internal and external in labor relations and labor relations in order to make the institutional framework of employer's liability more clear. The paper is divided into three parts. The first part introduces the classification of employers, according to the main body of the employment relationship. It is divided into employers in labor relations and employers in civil labor relations, and their scope and characteristics are introduced respectively. Including the employer's responsibility to the third party in the labor relations and the employer's responsibility to the third party in the labor relations, the author emphatically introduces the theoretical basis, the constitutive elements and the imputation principle of the employer's liability. The third part introduces the employer's internal responsibility. That is, the employer's liability to the employee in labor relations and the employer's liability to the employee's injury in the labor relationship. In a word, the problem of employer's liability is not only a complicated theoretical problem, but also a practical one. Balancing the interests of employers, employees and victims in order to meet the needs of the expansion of the employer's liability. At the time of the formulation of the Civil Code, drawing on the legislative experience of foreign countries and combining with the specific conditions of our country, it is a legislative trend to establish the employer's liability system.
