【摘要】:正實踐中,用人單位或與勞動者約定,或通過規(guī)章制度對勞動者的某些勞動報酬設定一定支付條件的情形較為常見。如用人單位規(guī)定員工年終考核合格后才可享受績效獎,年終獎對次年仍在職的員工發(fā)放,銷售提成獎按銷售款回款的比例或待銷售款全額到賬后支付,等等。有些用人單位規(guī)定將勞動者每月工資的一部分作為"業(yè)績提成"暫不發(fā)放,到年底考核時再根據(jù)勞動者的工作業(yè)績
