【摘要】： 農(nóng)民工進(jìn)城務(wù)工是我國農(nóng)村聯(lián)產(chǎn)承包責(zé)任制和城市經(jīng)濟(jì)體制改革的必然產(chǎn)物,我國農(nóng)民工為城市的經(jīng)濟(jì)建設(shè)做出了巨大的貢獻(xiàn),然而,農(nóng)民工合法權(quán)益受侵害是一個長期以來存在的普遍現(xiàn)象。種種不合理、不公正的現(xiàn)象發(fā)生在我國廣大的農(nóng)民工身上,這極大的打擊了農(nóng)民工工作的積極性,不利于我國經(jīng)濟(jì)的進(jìn)一步發(fā)展和社會的和諧穩(wěn)定。農(nóng)民工的問題引起了社會各界的普遍關(guān)注,黨中央、國務(wù)院也高度重視農(nóng)民工問題。黨的十六大以來,國家對農(nóng)民工采取了積極引導(dǎo)的政策。2004年、2005年、2006年,連續(xù)出臺的三個中央1號文件都強調(diào)了解決農(nóng)民工問題的重要性。面對如此重要的現(xiàn)實問題,許多學(xué)者積極調(diào)研探索,提出了許多有益的保障農(nóng)民工權(quán)益的見解。筆者在廣泛收集了有關(guān)農(nóng)民工問題的著作、論文和相關(guān)的網(wǎng)絡(luò)信息的基礎(chǔ)上展開寫作。本文分四章:第一章為引言,介紹了選題的背景和現(xiàn)實意義、國內(nèi)外研究狀況,以及本文研究的主要內(nèi)容。在第二章中,概括了我國農(nóng)民工的概念與身份,分析了農(nóng)民工的發(fā)展壯大以及農(nóng)民工的作用。在第三章中,分析我國農(nóng)民工權(quán)益難以保障的現(xiàn)狀和原因。第四章是本文的重點,針對前一章分析的我國農(nóng)民工權(quán)益難以保障的現(xiàn)狀和原因,提出了相應(yīng)的解決辦法。保障農(nóng)民工權(quán)益的首要問題是要保障其勞動報酬權(quán),為此必須建立農(nóng)民工工資支付保障制度;其次,解決農(nóng)民工權(quán)益受侵害的深層次問題是建立城鄉(xiāng)統(tǒng)一的勞動力市場和就業(yè)服務(wù)體系;再次,完善現(xiàn)有法律法規(guī)對農(nóng)民工權(quán)益的保障;最后,針對我國農(nóng)民工自身的一些特殊情況,制定切實保障我國農(nóng)民工權(quán)益的相關(guān)規(guī)章制度。
[Abstract]:Migrant workers working in cities are the inevitable outcome of the rural contract responsibility system and the reform of the urban economic system. The migrant workers in our country have made great contributions to the economic construction of the city, however, The violation of the legitimate rights and interests of migrant workers is a common phenomenon that has existed for a long time. All kinds of unreasonable and unfair phenomena have occurred on the vast number of migrant workers in our country, which has greatly hit the enthusiasm of migrant workers' work. The issue of migrant workers has aroused widespread concern from all walks of life. The Party Central Committee and the State Council have also attached great importance to the issue of migrant workers. Since the 16th National Congress of the Party, On 2004, 2005 and 2006, three successive documents of the Central Committee, No. 1, all emphasized the importance of solving the problem of migrant workers. Faced with such important practical problems, many scholars actively investigated and explored. I have put forward a lot of useful opinions on protecting the rights and interests of migrant workers. The author has extensively collected works, papers and related network information about migrant workers. This paper is divided into four chapters: the first chapter is the introduction. This paper introduces the background and practical significance of the topic, the research situation at home and abroad, and the main contents of this paper. In the second chapter, it summarizes the concept and status of migrant workers in China. In the third chapter, the author analyzes the current situation and reasons why the rights and interests of migrant workers are difficult to protect. Chapter 4th is the focus of this paper. In view of the current situation and reasons why the rights and interests of migrant workers are difficult to protect in the previous chapter, the corresponding solutions are put forward. The primary problem of protecting the rights and interests of migrant workers is to protect their right to remuneration. To this end, we must establish a wage payment security system for migrant workers. Secondly, to solve the deep problem of the infringement of migrant workers' rights and interests is to establish a unified labor market and employment service system in urban and rural areas. Thirdly, Improve the existing laws and regulations to protect the rights and interests of migrant workers; finally, in view of some special circumstances of migrant workers in China, formulate relevant rules and regulations to effectively protect the rights and interests of migrant workers in China.
