【摘要】:享有勞動權(quán)益是勞動者參加勞動的基本需求,其是否被保障及保障程度關(guān)系著勞動者的就業(yè)質(zhì)量、用人單位的生產(chǎn)績效和國家社會的穩(wěn)定。我國是社會主義國家,踐行以人為本的發(fā)展理念,始終將保障勞動者勞動權(quán)益、促進就業(yè)放在國家工作的重點位置,然而當前我國城市外來人口非正規(guī)就業(yè)者的勞動權(quán)益保障存在著許多問題,保障質(zhì)量有待提高。研究城市外來人口非正規(guī)就業(yè)者勞動權(quán)益保障具有重大的價值,它有利于促進社會公平,維護社會穩(wěn)定,是構(gòu)建社會主義和諧社會的應(yīng)有之義。本文以人力資本理論、社會支持理論和不完全競爭勞動力市場理論作為理論基礎(chǔ),對核心概念進行了界定,介紹了理論內(nèi)涵;運用歷史分析法理清了我國城市外來人口非正規(guī)就業(yè)者勞動權(quán)益保障的發(fā)展歷程;通過定性分析描繪了我國城市外來人口非正規(guī)就業(yè)者勞動權(quán)益保障的現(xiàn)狀,指出其存在的主要問題,結(jié)合相關(guān)理論發(fā)現(xiàn)這些問題有三大致因,分別是城市外來人口非正規(guī)就業(yè)者維權(quán)意識與維權(quán)能力不足、城市外來人口非正規(guī)就業(yè)勞動關(guān)系不和諧和政府城市外來人口非正規(guī)就業(yè)勞動權(quán)益保障能力弱;趶V州市在外來人口非正規(guī)就業(yè)者勞動權(quán)益保障中取得的成績,利用案例分析法,總結(jié)了其實踐,它啟示我國在保障城市外來人口非正規(guī)就業(yè)者勞動權(quán)益時要遵循多方參與、構(gòu)建和諧勞動關(guān)系、促進城市外來人口非正規(guī)就業(yè)者城市融入和加強城市外來人口非正規(guī)就業(yè)管理四個基本準則。為了更好地保障我國城市外來人口非正規(guī)就業(yè)者的勞動權(quán)益,應(yīng)構(gòu)建以提升城市外來人口非正規(guī)就業(yè)者維權(quán)意識與維權(quán)能力、營造城市外來人口非正規(guī)就業(yè)和諧勞動關(guān)系和增強政府城市外來人口非正規(guī)就業(yè)勞動權(quán)益保障能力為主要目標的包括政府、城市外來人口非正規(guī)就業(yè)者、用人單位和社會組織在內(nèi)的我國城市外來人口非正規(guī)就業(yè)者勞動權(quán)益多方合作型保障模式。應(yīng)從增加城市外來人口非正規(guī)就業(yè)者的人力資本和增強其社會支持兩個維度來提高其維權(quán)意識和維權(quán)能力,通過構(gòu)建城市外來人口非正規(guī)就業(yè)用人單位的自律機制和他律機制營造城市外來人口非正規(guī)就業(yè)和諧勞動關(guān)系,從提升政府的監(jiān)管能力和服務(wù)能力兩個層次來增強政府的城市外來人口非正規(guī)就業(yè)勞動權(quán)益保障能力。
[Abstract]:The enjoyment of labor rights and interests is the basic need for workers to participate in labor. Whether or not they are protected or not is related to the quality of employment of workers, the production performance of employers and the stability of national society. China is a socialist country. To practice the people-oriented development concept, the labor rights and interests of workers are always protected, and the promotion of employment is placed in the key position of the national work. However, there are many problems in the protection of the labor rights and interests of the non-regular employment workers of the urban migrant population in our country at present. The quality of the guarantee needs to be improved. It is of great value to study the protection of the labor rights and interests of the non-regular employment workers of the urban migrant population, which is conducive to promoting social equity and maintaining social stability. Based on human capital theory, social support theory and incomplete competitive labor market theory, this paper defines the core concepts and introduces the theoretical connotation. By using the method of historical analysis, this paper clarifies the course of the development of the protection of the labor rights and interests of the non-regular workers of the urban migrant population in China, and depicts the present situation of the protection of the rights and interests of the informal workers of the urban migrant population through qualitative analysis. This paper points out its main problems, and finds that there are three main reasons for these problems, which are the lack of awareness and ability of protecting rights of non-regular employment workers in the city. The non-formal employment labor relationship of the urban migrant population is not harmonious and the government has a weak ability to guarantee the rights and interests of the informal employment of the urban migrant population. Based on the achievements made in the protection of the labor rights and interests of the non-regular employment workers of the migrant population in Guangzhou, Using the case analysis method, it summarizes its practice, which enlightens our country to follow the multi-party participation in protecting the labor rights and interests of the non-regular workers of the urban migrant population, and to build a harmonious labor relationship. To promote the integration and strengthening of the informal employment management of the urban migrant population in cities. In order to better protect the labor rights and interests of the informal employment workers of the urban migrant population in China, It should be constructed to enhance the awareness and ability of non-regular workers in urban areas to protect their rights. The main objectives of building a harmonious labor relationship among the urban migrant population, informal employment and enhancing the ability of the government to guarantee the rights and interests of the non-regular employment of the urban migrant population include the government, the urban migrant population, the informal workers, Employment units and social organizations in China's urban migrant population informal employment workers labor rights and interests of multiple cooperative security model. Should be from the increase of urban non-regular employment of the human capital and enhance their social support two. To improve their awareness and ability to protect their rights, Through the construction of the self-discipline mechanism and the heteronomy mechanism of the informal employment of the urban migrant population, the harmonious labor relationship between the informal employment of the urban migrant population and the non-employment of the urban migrant population is established. To enhance the government's ability of protecting the rights and interests of the informal employment of the urban migrant population from the two levels of enhancing the government's supervision and service ability.
