【摘要】： 隨著工業(yè)化的推進(jìn)和城市化進(jìn)程的加速,中國農(nóng)村勞動(dòng)力正進(jìn)行著歷史性的轉(zhuǎn)移。當(dāng)前我國農(nóng)民工約有1.5億人,其正逐步成為我國新一代產(chǎn)業(yè)工人的主體。龐大的農(nóng)民工群體以其辛勤勞動(dòng)為我國城鄉(xiāng)建設(shè)做出了巨大貢獻(xiàn)。但是,我國安全生產(chǎn)事故頻發(fā),職業(yè)病、傳染病危害嚴(yán)重,其中農(nóng)民工占到了傷亡人數(shù)的80%。可見,農(nóng)民工的生命安全和身體健康正在遭受嚴(yán)重侵害。這也凸顯了農(nóng)民工勞動(dòng)保護(hù)機(jī)制運(yùn)行的現(xiàn)實(shí)困境。如何破解農(nóng)民工勞動(dòng)保護(hù)機(jī)制的運(yùn)行困境,還農(nóng)民工以切實(shí)到位的安全和衛(wèi)生保護(hù)是我國當(dāng)前亟待解決的重大問題,也引起了全社會(huì)的廣泛關(guān)注。 就農(nóng)民工的法律地位而言,其并無特殊性,因此本文對(duì)于農(nóng)民工勞動(dòng)保護(hù)機(jī)制的分析是在保護(hù)勞動(dòng)者的總體視野下進(jìn)行的。文中首先對(duì)農(nóng)民工和勞動(dòng)保護(hù)機(jī)制進(jìn)行準(zhǔn)確界定。然后在對(duì)我國農(nóng)民工的勞動(dòng)保護(hù)機(jī)制現(xiàn)況進(jìn)行實(shí)證調(diào)查和資料查詢的基礎(chǔ)上,運(yùn)用當(dāng)代先進(jìn)法學(xué)理論和法律社會(huì)學(xué)研究方法對(duì)農(nóng)民工勞動(dòng)保護(hù)的機(jī)制困境進(jìn)行多角度、深層次原因分析,并借鑒國內(nèi)外勞動(dòng)保護(hù)成果,針對(duì)我國國情提出了破解農(nóng)民工勞動(dòng)保護(hù)機(jī)制運(yùn)行困境的應(yīng)對(duì)之策。 論文共分四部分: 第一部分主要對(duì)農(nóng)民工和勞動(dòng)保護(hù)機(jī)制進(jìn)行概念界定。筆者把農(nóng)民工界定為:具有農(nóng)村戶口身份,長期或一定時(shí)期內(nèi)在城鎮(zhèn)務(wù)工的勞動(dòng)者。本文所指勞動(dòng)保護(hù)機(jī)制是指由勞動(dòng)保護(hù)各要素相互聯(lián)系、相互作用,從而發(fā)揮勞動(dòng)保護(hù)功能的作用原理。其研究對(duì)象是我國的農(nóng)民工弱勢(shì)群體,研究的范圍涉及我國農(nóng)民工勞動(dòng)保護(hù)的立法、執(zhí)法、司法、守法等諸多方面。具體研究內(nèi)容是農(nóng)民工生產(chǎn)勞動(dòng)期間生命安全和身體健康。 第二部分從應(yīng)然與實(shí)然的角度對(duì)當(dāng)前我國農(nóng)民工勞動(dòng)保護(hù)機(jī)制建設(shè)所取得的進(jìn)展和存在的問題進(jìn)行考察,認(rèn)為我國對(duì)于農(nóng)民工的勞動(dòng)保護(hù)已初步形成了一個(gè)覆蓋農(nóng)民工生命安全和身體健康的日常預(yù)防、工傷救助、醫(yī)療保障和事故處理的綜合法律體系,為我國農(nóng)民工依法維權(quán)創(chuàng)造了前提條件。同時(shí)指出了當(dāng)前農(nóng)民工勞動(dòng)保護(hù)領(lǐng)域中普遍存在的勞動(dòng)保護(hù)措施缺失、社會(huì)保險(xiǎn)缺位、勞動(dòng)用人制度不規(guī)范、維權(quán)之路受阻、勞動(dòng)監(jiān)察不力和工會(huì)維權(quán)失落等諸多問題。 第三部分從經(jīng)濟(jì)、政治、文化、法律規(guī)范幾重維度,運(yùn)用邏輯分析、比較分析、系統(tǒng)分析的研究方法,借鑒西方權(quán)利法學(xué)、法律經(jīng)濟(jì)學(xué)、經(jīng)濟(jì)博弈論、文化解釋學(xué)等理論進(jìn)行深入分析,探求農(nóng)民工勞動(dòng)保護(hù)機(jī)制運(yùn)行困境的深層次原因,為對(duì)策分析奠定堅(jiān)實(shí)基礎(chǔ)。在經(jīng)濟(jì)因素方面對(duì)農(nóng)民工勞動(dòng)保護(hù)機(jī)制運(yùn)行維權(quán)困境進(jìn)行馬克思主義法學(xué)分析,對(duì)農(nóng)民工勞動(dòng)保護(hù)問題形成進(jìn)行制度經(jīng)濟(jì)學(xué)分析,對(duì)農(nóng)民工簽訂勞動(dòng)合同過程進(jìn)行博弈論解讀,對(duì)工會(huì)維權(quán)進(jìn)行經(jīng)濟(jì)效率分析,對(duì)勞動(dòng)保護(hù)措施缺失進(jìn)行安全經(jīng)濟(jì)學(xué)分析,對(duì)農(nóng)民工維權(quán)進(jìn)行成本探討;在政治因素方面主要探討農(nóng)民工勞動(dòng)保護(hù)機(jī)制運(yùn)行中的權(quán)力博弈、二元身份的圍城和國家功能的錯(cuò)位問題;在法律文化傳統(tǒng)方面指出了崇無訟、重調(diào)處的法律傳統(tǒng)和權(quán)尊于法的傳統(tǒng)對(duì)農(nóng)民工維權(quán)的影響;并探討了農(nóng)民工勞動(dòng)保護(hù)的憲法維度、民事法律維度、勞動(dòng)法維度、刑事法律維度。 第四部分在前述分析的基礎(chǔ)上,借鑒國內(nèi)外勞動(dòng)保護(hù)成功經(jīng)驗(yàn),提出了在已有農(nóng)民工勞動(dòng)保護(hù)機(jī)制基礎(chǔ)上,完善以立法、司法、執(zhí)法和守法為中心的勞動(dòng)保護(hù)機(jī)制,并從法律體系、保護(hù)主體、司法改革、執(zhí)法監(jiān)督、工會(huì)維權(quán)、自身維權(quán)、非政府組織維權(quán)等多個(gè)方面提出完善我國農(nóng)民工勞動(dòng)保護(hù)機(jī)制的對(duì)策。主要包括:(1)進(jìn)一步完善有關(guān)農(nóng)民工勞動(dòng)保護(hù)當(dāng)前的法律體系;(2)明確定位國家勞動(dòng)保護(hù)主體;(3)改革現(xiàn)行司法體制;(4)加強(qiáng)農(nóng)民工勞動(dòng)保護(hù)的執(zhí)法和監(jiān)察;(5)構(gòu)建涵蓋農(nóng)民工的社會(huì)保障機(jī)制;(6)培育農(nóng)民工自主維權(quán)機(jī)制(7)建立農(nóng)民工工會(huì)維權(quán)機(jī)制;(8)鼓勵(lì)法律援助機(jī)構(gòu)和NGO(非政府組織)參與農(nóng)民工勞動(dòng)保護(hù)。
[Abstract]:With the acceleration of industrialization and the acceleration of urbanization , China ' s rural labor force is undergoing a historic transfer . At present , some 150 million migrant workers in China are gradually becoming the main body of our new generation of industrial workers . However , the safety and health of migrant workers are suffering from serious violations . In the light of the legal status of migrant workers , it is not special , so the paper makes an accurate definition of the mechanism of migrant worker ' s labor protection . Then , based on the empirical investigation and information inquiry of the status of the labor protection mechanism of migrant workers in China , this paper analyzes the mechanism predicament of migrant worker ' s labor protection by means of modern advanced law theory and legal sociology research method , and puts forward the countermeasures to solve the problem of migrant worker ' s labor protection mechanism . The thesis is divided into four parts : The first part mainly defines the concept of migrant workers and labor protection mechanisms . The author defines the migrant workers as workers who have rural residence status , long - term or certain period of time . The research object is the legislation , law enforcement , judicial , law - abiding and other aspects of the labor protection of migrant workers in our country . The research contents are the life safety and health of migrant workers during the productive labor . The second part investigates the progress and problems of the construction of the labor protection mechanism of migrant workers in China from the angle of stress and reality . It is believed that the comprehensive legal system covering the life safety and health of the migrant workers has formed a comprehensive legal system which covers the life safety and the health of the migrant workers . In the third part , from the aspects of economic , political , cultural and legal norms , the author deeply analyzes the causes of the running of the labor protection mechanism of migrant workers , analyzes the causes of the running of the labor protection mechanism of migrant workers , analyzes the causes of the labor protection mechanism of migrant workers , analyzes the causes of the labor protection mechanism of migrant workers , analyzes the causes of the labor protection of migrant workers , analyzes the influence of the traditional law tradition and the right respect to the rights of migrant workers , and discusses the constitution dimension , the civil law dimension , the labor law dimension and the criminal law dimension of the migrant workers ' labor protection . The fourth part , on the basis of the previous analysis , puts forward the countermeasures of perfecting the labor protection mechanism of the migrant workers based on the experience of labor protection at home and abroad .
