【摘要】：只要是具有勞動權(quán)利能力和勞動行為能力的人,都應(yīng)該享有平等的就業(yè)權(quán)利與機會,除獲得報酬和經(jīng)營收入以外,還要在用工條件和從業(yè)環(huán)境、接受就業(yè)訓(xùn)練和職業(yè)培訓(xùn)、享受國家統(tǒng)一的社會保障,甚至在子女接受義務(wù)教育等方面享有平等的權(quán)利。因為勞動力就業(yè)實質(zhì)是一個持續(xù)的經(jīng)濟運行過程,穩(wěn)定和可持續(xù)性是其關(guān)鍵。 為尋求生存與發(fā)展,“民工潮”一夜之間涌向城市,也帶來了一系列問題。而所謂的“農(nóng)民工問題”,其實包涵兩個層次:使農(nóng)民工徘徊在城市的邊緣的城市戶籍、城市社會保障、城市教育等諸多制度限制;以及伴隨著從業(yè)過程中違法解除勞動合同、收取就業(yè)保證金、拖欠克扣工資、拖欠社會保險費等權(quán)益侵害問題。關(guān)鍵在于要認識到農(nóng)民工問題是社會問題,其實質(zhì)是要在城鄉(xiāng)二元經(jīng)濟結(jié)構(gòu)走向一體化的形勢下解決農(nóng)村剩余勞動力的就業(yè)問題。 本文嘗試以農(nóng)民工在城市的生存和就業(yè)為突破口,以20 世紀七十年代末到九十年代初經(jīng)濟體制改革后的城鄉(xiāng)發(fā)展變化為歷史背景,探尋農(nóng)民工問題由產(chǎn)生到顯現(xiàn)直至發(fā)展成社會問題背后隱藏的經(jīng)濟、政治和社會規(guī)律,進而分析農(nóng)民工城市生存的經(jīng)濟基礎(chǔ)和社會合理性,論證市場準入、擇業(yè)和從業(yè)環(huán)境等制度限制與排斥隱含的實質(zhì)是政府的管理錯位和服務(wù)缺位,政府由管理向服務(wù)的觀念轉(zhuǎn)變和農(nóng)民工自身的發(fā)展是農(nóng)民工充分平等就業(yè)的關(guān)鍵。
[Abstract]:As long as they have the capacity to work and the capacity to act, they should enjoy equal employment rights and opportunities, in addition to remuneration and operating income, but also in the employment conditions and employment environment. Receiving employment training and vocational training, enjoying the unified social security of the country, and even enjoying equal rights in the compulsory education of children, etc., because the employment of the labour force is essentially a continuous process of economic operation. Stability and sustainability are key. In order to seek survival and development, "migrant workers" rushed to the city overnight, also brought a series of problems. And the so-called "migrant workers problem." In fact, it contains two levels: the urban household registration, urban social security, urban education and many other institutional restrictions that make migrant workers hovering on the edge of the city; Along with the illegal rescission of labor contracts in the course of employment, the collection of employment deposits, arrears of wages, arrears of social insurance and other rights and interests violations. The key lies in recognizing that the problem of migrant workers is a social problem. Its essence is to solve the employment problem of rural surplus labor force under the situation of urban-rural dual economic structure moving towards integration. This paper attempts to make the survival and employment of migrant workers in the city as a breakthrough, taking the urban and rural development changes after the economic system reform from the end of 1970s to the beginning of 90s as the historical background. This paper explores the hidden economic, political and social laws behind the problems of migrant workers from their emergence to appearance until they develop into social problems, and then analyzes the economic basis and social rationality of the existence of migrant workers, and demonstrates the market access. The essence of the system restriction and exclusion such as job selection and employment environment is the misplacement of government management and the absence of service. The transformation of the concept of government from management to service and the development of migrant workers themselves are the key to the full and equal employment of migrant workers.
