集體合同制度研究

【摘要】:從集體合同的起源及在西方的歷史演變過程中,我們可以看出集體合同制度在社會生活中的重要作用以及它之所以發(fā)展成為西方一項基本制度且長盛不衰的原因。我國集體合同制度亦有過一定時期的發(fā)展,但在我國的實施狀況卻不盡如人意。沒能夠產(chǎn)生相應(yīng)的社會效果,這與我國的工會制度、集體協(xié)商制度、集體合同本身的一些規(guī)定、勞動者罷工權(quán)的有無以及政府作用的發(fā)揮等相關(guān)因素有關(guān)。目前,我國剛剛加入世界貿(mào)易組織,經(jīng)濟(jì)體制改革也在進(jìn)一步深化,勞動者的權(quán)益需要更為有力的保護(hù),集體合同制度亟待完善。 本文從集體合同的概念、內(nèi)容、簽訂、履行、效力、爭議解決和責(zé)任機(jī)制等方面,嘗試了在結(jié)合理論與實踐的基礎(chǔ)上,以比較國外集體合同制度與國內(nèi)集體合同的現(xiàn)有制度為契機(jī),較為全面的對集體合同進(jìn)行了探討。試圖從影響集體合同制度發(fā)揮作用的原因著手,希望通過擴(kuò)大集體談判的主體范圍、承認(rèn)集體合同的普遍效力和余后效力、立法明確規(guī)定罷工權(quán)建立工會獨立性保障機(jī)制以及正確發(fā)揮政府作用等幾個方面來逐步完善集體合同制度,以達(dá)到有效保障勞動者權(quán)益的目的。
[Abstract]:From the origin of collective contract and the historical evolution process in the West. We can see the important role of the collective contract system in social life and the reason why it has developed into a basic system in the West. However, the implementation situation in our country is not satisfactory. It can not produce the corresponding social effect, which is related to the trade union system, collective negotiation system, collective contract itself. At present, China has just joined the World Trade Organization, and the economic system reform is further deepened. Laborer's rights and interests need more powerful protection, collective contract system needs to be perfected urgently. This paper attempts to combine theory with practice from the concept, content, signing, performance, validity, dispute settlement and liability mechanism of collective contract. Taking the opportunity of comparing the foreign collective contract system with the domestic collective contract system, this paper discusses the collective contract comprehensively, and tries to start with the reasons that influence the collective contract system. It is hoped that by expanding the scope of the subject of collective bargaining, the universal validity and residual effect of collective contract will be recognized. The legislation clearly stipulates that the right to strike should establish the independent safeguard mechanism of trade unions and give full play to the role of the government in order to gradually perfect the collective contract system in order to effectively protect the rights and interests of workers.
