【摘要】:近年來,車輛掛靠經(jīng)營已成為運輸行業(yè)廣泛存在的一種特殊現(xiàn)象,在這種經(jīng)營模式下發(fā)生的勞動爭議也隨之頻繁。但目前對于這種經(jīng)營模式下出現(xiàn)的勞動爭議,尤其是界定勞動者與用人單位是否存在勞動關(guān)系的問題,學(xué)界還存在較大的爭議,難以達成共識。實踐中,審判者在審理此類案件時也只能憑借自身對案件的理解進行自由裁量,造成各地法院對同一類事實的案件出現(xiàn)不同的觀點和判決,使當(dāng)事人對于判決結(jié)果無法信服,不僅侵犯了當(dāng)事人的合法權(quán)益,而且嚴重違背了法律的公平和正義。因此,有必要在理論上對此類案件進行分析探討,以求盡快達成共識,維護法律的統(tǒng)一性。 本文正文主要分為三個部分。第一部分主要介紹了張某與A公司之間有關(guān)車輛掛靠經(jīng)營中勞動爭議案件的基本案情以及本案爭議的兩個焦點問題,一是受聘司機與被掛靠單位是否存在勞動關(guān)系的問題,二是法律責(zé)任應(yīng)如何承擔(dān)的問題。第二部分主要是對本案的爭議問題進行深入地分析和探討,首先重點分析本案中勞動關(guān)系的認定問題,主要從勞動關(guān)系認定的理論分析、車輛掛靠經(jīng)營法律關(guān)系分析以及本案勞動關(guān)系的認定問題分析三個方面進行討論研究;其次分析法律責(zé)任的承擔(dān)問題,也包括兩個方面,即在認定存在勞動關(guān)系的情況下法律責(zé)任如何承擔(dān)和認定不存在勞動關(guān)系的情況下法律責(zé)任如何承擔(dān)的問題。第三部分闡述了本案的判決結(jié)果及由本案引發(fā)的法律思考。由本案一、二審法院不同的判決結(jié)果及處理情況,引發(fā)討論處理此類案件所亟待解決的法律問題,針對該法律問題,提出兩個方面的建議:一是明確認定勞動關(guān)系的標(biāo)準(zhǔn),二是完善車輛掛靠經(jīng)營立法。 本文通過對一個具體且具有典型性的車輛掛靠經(jīng)營中勞動爭議糾紛案例進行分析,重點研究了該案例爭議的焦點問題,從而提出了該案例以及類似案件體現(xiàn)出的法律問題和對此的相關(guān)建議,希望對我國今后此類案件的審理提供一些理論上的參考和依據(jù)。
[Abstract]:In recent years, vehicle linking operation has become a special phenomenon in the transportation industry, and the labor disputes in this mode also occur frequently, but for the current labor disputes under this mode of operation. In particular, to define whether there is a labor relationship between the laborer and the employing unit, there are still a lot of disputes in academic circles, so it is difficult to reach a consensus. In practice. Judges in such cases can only rely on their own understanding of the case for discretion, resulting in local courts on the same type of fact cases appear different views and judgments. Not only infringes the legitimate rights and interests of the parties, but also seriously violates the fairness and justice of the law. Therefore, it is necessary to analyze and explore this kind of cases in theory. In order to reach a consensus as soon as possible and maintain the unity of the law. The main body of this paper is divided into three parts. The first part mainly introduces the basic facts of the labor dispute case between Zhang and A company and the two focal points of the dispute. The first is whether there is a labor relationship between the employed driver and the affiliated unit, and the second is how to bear the legal liability. The second part is mainly about the in-depth analysis and discussion of the dispute in this case. First of all, it focuses on the identification of labor relations in this case, mainly from the theoretical analysis of labor relations. The analysis of the legal relationship of the vehicle linking operation and the determination of the labor relations in this case are discussed and studied in three aspects. Secondly, it analyzes the problem of legal liability, including two aspects. That is, how to assume the legal liability in the case of the existence of labor relations and how to assume the legal liability in the case where there is no labor relationship. The third part expounds the result of the judgment and the law triggered by the case. Law of thought. In this case. The court of second instance of different judgments and handling of the situation, led to a discussion of the legal issues to be solved in such cases, in view of the legal issues, put forward two aspects of the proposal: first, clear determination of the standard of labor relations. Second, improve the legislation on the operation of vehicles. Through the analysis of a specific and typical case of labor dispute dispute in the management of vehicle alignment, this paper focuses on the focus of the case dispute. This paper puts forward the legal problems and relevant suggestions of this case and similar cases, and hopes to provide some theoretical references and basis for the trial of such cases in the future in our country.
