【摘要】：《工會法》規(guī)定,工會主席在任職期間,其勞動合同自動延長。本案當事人雖然勞動合同到期,但其仍然擔任工會主席一職,用人單位如果不再續(xù)訂合同,也不能終止與其的勞動關系。本文認為,是用人單位提前解除與當事人的勞動合同,應依法支付經濟補償金。
[Abstract]:According to the Law of the Trade Union , the labor contract of the chairman of the trade union shall be extended automatically during the term of office . If the party fails to renew the contract , the employing unit shall not terminate the labor relationship with the party . If the employing unit cancels the contract with the party in advance , it shall pay the economic compensation in accordance with the law .
