【摘要】：隨著互聯(lián)網(wǎng)技術(shù)的飛速發(fā)展,云計(jì)算這個(gè)概念孕育而生,云計(jì)算是一種將信息技術(shù)服務(wù)變?yōu)槿藗儔裘乱郧蟮墓迷O(shè)施的技術(shù)手段和商業(yè)模式,它對(duì)世界經(jīng)濟(jì)發(fā)展和社會(huì)進(jìn)步產(chǎn)生了深刻的影響,加速了人類社會(huì)整體步入全球化、知識(shí)化的新時(shí)代。然而,云計(jì)算的出現(xiàn)給傳統(tǒng)網(wǎng)絡(luò)環(huán)境下的商業(yè)秘密保護(hù)也帶來了較為嚴(yán)峻的挑戰(zhàn)。云計(jì)算環(huán)境下的商業(yè)秘密保護(hù)較之傳統(tǒng)的商業(yè)秘密保護(hù)而言呈現(xiàn)出很多新的特征。與此同時(shí),也發(fā)生了一系列的云中商業(yè)秘密泄露的事件,這對(duì)云計(jì)算的發(fā)展又產(chǎn)生了一定的阻礙作用。由于現(xiàn)階段我國對(duì)于云計(jì)算中商業(yè)秘密保護(hù)的意識(shí)還較為薄弱,相關(guān)的制度也不盡完善,與之相關(guān)的法律、法規(guī)也未能及時(shí)跟進(jìn)。因此,在這種情況下,如何既能促進(jìn)云計(jì)算技術(shù)的發(fā)展又能切實(shí)有效的保障商業(yè)秘密權(quán)利人的權(quán)利,成為目前業(yè)界一個(gè)焦點(diǎn)問題。本文從以下四個(gè)方面來研究云計(jì)算環(huán)境下商業(yè)秘密的法律保護(hù)問題。第一:理清云計(jì)算和商業(yè)秘密的概念以及兩者之間的聯(lián)系,并闡述在云計(jì)算環(huán)境下商業(yè)模式對(duì)商業(yè)秘密的影響;第二:介紹了云計(jì)算環(huán)境下商業(yè)秘密存在的新形式,以及對(duì)商業(yè)秘密侵害的方式和新特點(diǎn),并分析商業(yè)秘密侵權(quán)和侵害商業(yè)秘密的行為的區(qū)別;第三:介紹云計(jì)算環(huán)境下商業(yè)秘密法律保護(hù)的現(xiàn)狀及其問題,主要介紹我國現(xiàn)階段云環(huán)境下商業(yè)秘密法律保護(hù)的立法情況,及現(xiàn)階段存在的窘境,以及國外有關(guān)云中商業(yè)秘密的法律保護(hù)的相關(guān)借鑒;第四章:提出如何完善云計(jì)算中的商業(yè)秘密的法律保護(hù)的策略。本文針對(duì)上述問題,在厘清云計(jì)算的概念、類型等的基礎(chǔ)上,從用戶、云服務(wù)商、第三方監(jiān)管、國家監(jiān)管、建立國際公約保護(hù)商業(yè)秘密等不同的角度,吸收和借鑒國外關(guān)于云計(jì)算環(huán)境下商業(yè)秘密保護(hù)的相關(guān)經(jīng)驗(yàn),最終落腳于中國的實(shí)際情況,結(jié)合中國云計(jì)算的產(chǎn)生和發(fā)展的過程,研究中國云計(jì)算環(huán)境下商業(yè)秘密的法律保護(hù)問題,制定切實(shí)可行的關(guān)于云中商業(yè)秘密保護(hù)的相關(guān)立法,并就以上問題提出自己的相關(guān)建議。
[Abstract]:With the rapid development of Internet technology, the concept of cloud computing was born. Cloud computing is a kind of technical means and business model to turn information technology service into a coveted public facility. It has a profound impact on the development of the world economy and social progress, and accelerates the whole human society into a new era of globalization and knowledge. However, the emergence of cloud computing has also brought more serious challenges to the protection of trade secrets in the traditional network environment. Compared with the traditional trade secret protection, the trade secret protection in cloud computing environment presents many new characteristics. At the same time, a series of business secrets in the cloud have been leaked, which has a certain hindrance to the development of cloud computing. At present, China's awareness of the protection of trade secrets in cloud computing is still relatively weak, the relevant systems are not perfect, and the relevant laws and regulations have not been followed up in time. Therefore, in this case, how to not only promote the development of cloud computing technology, but also effectively protect the rights of trade secret rights holders, has become a focus of the current industry. This paper studies the legal protection of trade secrets in cloud computing environment from the following four aspects. The first is to clarify the concepts of cloud computing and trade secrets and the relationship between them, and to explain the influence of business model on trade secrets in cloud computing environment. Second, this paper introduces the new forms of trade secrets in cloud computing environment, as well as the ways and characteristics of infringement of trade secrets, and analyzes the differences between trade secret infringement and infringement of trade secrets. The third: introduces the present situation and problems of the legal protection of trade secrets in the cloud computing environment, mainly introduces the legislation of the legal protection of trade secrets in the cloud environment of our country at the present stage, and the dilemma existing at the present stage, as well as the relevant reference of the legal protection of trade secrets in the cloud abroad; chapter IV: puts forward the strategy of how to perfect the legal protection of trade secrets in cloud computing. In view of the above problems, on the basis of clarifying the concept and types of cloud computing, from the different angles of users, cloud service providers, third party supervision, national supervision, the establishment of international conventions to protect trade secrets, this paper absorbs and draws lessons from the relevant experience of foreign countries on the protection of trade secrets in cloud computing environment, and finally settled in the actual situation of China, combined with the process of the emergence and development of cloud computing in China. This paper studies the legal protection of trade secrets in cloud computing environment in China, formulates feasible legislation on the protection of trade secrets in the cloud, and puts forward some relevant suggestions on the above issues.
