【摘要】：大部分國家在WTO框架下對(duì)于任何形式的補(bǔ)貼都采取嚴(yán)格限制的態(tài)度,唯獨(dú)在出口信用保險(xiǎn)方面,各國政府達(dá)成了高度一致,允許其以滿足特定條件的形式存在�！堆a(bǔ)貼與反補(bǔ)貼協(xié)議》(以下稱“《SCM協(xié)議》”)對(duì)補(bǔ)貼的限制適用于出口信用保險(xiǎn),并在附件一《出口補(bǔ)貼例示清單》第(J)、(K)項(xiàng)對(duì)出口信用保險(xiǎn)屬于禁止性補(bǔ)貼的情況作了明確規(guī)定。2014年,我國商務(wù)部批準(zhǔn)中國太平洋、中國平安等3家保險(xiǎn)公司試點(diǎn)經(jīng)營出口信用保險(xiǎn),而早在2013年最高院就已做出批復(fù):在出口信用保險(xiǎn)合同與《保險(xiǎn)法》沖突時(shí),適用保險(xiǎn)合同約定。一方面,我國急于放開出口信用保險(xiǎn)市場(chǎng),另一方面,我們對(duì)出口信用保險(xiǎn)的特點(diǎn)研究還不夠充分,立法仍需完善。因此,本文通過對(duì)《SCM協(xié)議》下補(bǔ)貼的成立要件進(jìn)行分析,旨在指出我國出口信用保險(xiǎn)實(shí)踐操作中的不足并提出改善建議。
[Abstract]:Most countries have adopted strict restrictions on any form of subsidies within the framework of WTO, except for export credit insurance, where governments have reached a high degree of agreement. Allow it to exist in the form of satisfying specific conditions. The restrictions on subsidies in the subsidy and countervailing Agreement (hereinafter referred to as the "SCM Agreement") apply to export credit insurance and are in Annex I, sample list of Export subsidies, (J),. The (K) item clearly stipulates that export credit insurance belongs to prohibited subsidies. In 2014, the Ministry of Commerce of China approved three insurance companies, such as Pacific and Ping an of China, to conduct export credit insurance on a pilot basis. As early as 2013, the Supreme Court issued a reply: when the export credit insurance contract conflicts with the Insurance Law, the insurance contract agreement shall be applied. On the one hand, our country is eager to liberalize the export credit insurance market, on the other hand, our research on the characteristics of export credit insurance is not enough, and the legislation still needs to be improved. Therefore, through the analysis of the establishment elements of subsidies under the SCM Agreement, this paper aims to point out the shortcomings in the practical operation of export credit insurance in China and put forward some suggestions for improvement.
