網(wǎng)絡借貸中借款人道德風險行為分析及規(guī)制策略

【摘要】：網(wǎng)絡借貸作為最能體現(xiàn)互聯(lián)網(wǎng)金融精神的一種新型金融組織形式,在解決跨地域、跨時空的小微企業(yè)以及個人融資難題上發(fā)揮了重要作用。網(wǎng)絡借貸在通過現(xiàn)代信息技術手段解決民間融資難題的同時,也不可避免地面臨著難以監(jiān)控的道德風險,隨著《網(wǎng)絡借貸信息中介機構(gòu)業(yè)務活動管理暫行辦法》的出臺,網(wǎng)絡借貸平臺的道德風險行為勢必會得到一定程度的抑制,然而對于借款人的道德風險違約行為,依然存在著規(guī)制空白。由此,如何規(guī)避擁有絕對信息優(yōu)勢且缺乏抵押擔保資產(chǎn)借款人的道德風險行為成為亟待解決的關鍵科學問題。
[Abstract]:As a new type of financial organization which can reflect the financial spirit of the Internet, the network loan plays an important role in solving the small micro-enterprises and the individual financing problems of the cross-region and space-time. In order to solve the problem of the private financing through the modern information technology means, the network loan is also inevitably faced with the moral hazard which is difficult to monitor, and with the introduction of the Interim Measures for the Management of the Business Activity of the Network and Credit Information Intermediaries, The moral hazard behavior of the network lending platform is bound to be restrained to a certain extent, however, there is a regulation gap for the borrower's moral hazard default behavior. Therefore, how to avoid the moral hazard behavior of the borrower with the absolute information advantage and lack of the mortgage guarantee assets becomes the key scientific problem to be solved urgently.
