【摘要】："互聯(lián)網(wǎng)+"是把互聯(lián)網(wǎng)的創(chuàng)新成果與經(jīng)濟社會各領(lǐng)域深度融合,網(wǎng)絡(luò)交易平臺金融是互聯(lián)網(wǎng)技術(shù)、商業(yè)與金融深度融合的產(chǎn)物,是"互聯(lián)網(wǎng)+"的典型代表,主要包括第三方支付、互聯(lián)網(wǎng)投資理財產(chǎn)品、眾籌、網(wǎng)絡(luò)信貸等類型,其與P2P等新興互聯(lián)網(wǎng)金融在角色擔(dān)任、信息基礎(chǔ)、風(fēng)控能力等方面多有不同。司法應(yīng)當(dāng)在抓住網(wǎng)絡(luò)交易平臺金融法律關(guān)系的基礎(chǔ)上,針對網(wǎng)絡(luò)交易平臺金融糾紛審理中存在的問題,完善相關(guān)的機制,在鼓勵創(chuàng)新的同時保護金融消費者合法權(quán)益,明確信息披露義務(wù),完善糾紛解決機制。
[Abstract]:"the Internet" is the deep integration of the innovative achievements of the Internet with various fields of the economy and society, and the finance of the network trading platform is the product of the deep integration of the Internet technology, commerce and finance, and is the typical representative of the "Internet." Mainly include the third party payment, Internet investment financial products, crowdfunding, network credit and other types, and P2P and other emerging Internet finance in the role of the role, information base, risk control capabilities and other aspects are different. The judiciary should, on the basis of grasping the financial legal relationship of the online trading platform, aim at the problems existing in the adjudication of financial disputes on the online trading platform, improve the relevant mechanisms, and protect the legitimate rights and interests of financial consumers while encouraging innovation. Clarify the obligation of information disclosure and improve the dispute resolution mechanism.
