【摘要】：政府采購源于西方發(fā)達(dá)資本主義國家,于國外已有上百年歷史,我國一些地區(qū)政府機(jī)構(gòu)改革試點(diǎn)早在上世紀(jì)末就已經(jīng)開始實行。政府采購規(guī)模經(jīng)過十幾年的改革實踐,已經(jīng)慢慢形成了相關(guān)的法律制度,政府采購制度的基本框架慢慢形成。最近這幾年,經(jīng)濟(jì)活動中的商業(yè)賄賂現(xiàn)象幾乎滲透到社會經(jīng)濟(jì)生活的各個方面。政府采購領(lǐng)域作為社會經(jīng)濟(jì)活動的一個部分,也毫無例外地成為商業(yè)賄賂進(jìn)攻的主要對象。通過對政府采購中商業(yè)賄賂表現(xiàn)形式、事實現(xiàn)狀及法律缺陷、產(chǎn)生原因等進(jìn)行分析,提出完善政府采購制度的一些建議,以期有效地約束規(guī)范政府采購中的商業(yè)賄賂行為,避免商業(yè)賄賂在政府采購領(lǐng)域中繼續(xù)擴(kuò)大和蔓延。
[Abstract]:Government procurement originated from western developed capitalist countries and has a history of more than one hundred years. The pilot reform of government institutions in some regions of China has been implemented as early as the end of the last century. After more than ten years of reform practice, the scale of government procurement has gradually formed the relevant legal system, and the basic framework of government procurement system has gradually formed. In recent years, commercial bribery in economic activities has permeated almost all aspects of social and economic life. Government procurement as a part of social and economic activities, without exception, has become the main object of commercial bribery attack. Based on the analysis of the forms of commercial bribery in government procurement, the actual situation and legal defects, and the causes, some suggestions on how to perfect the system of government procurement are put forward in order to restrain and regulate the commercial bribery in government procurement effectively. To avoid commercial bribery in the field of government procurement continues to expand and spread.
