航空運輸延誤相關(guān)法律問題研究

【摘要】:航空法中的延誤包括航班延誤和航空運輸延誤,航空運輸延誤不等同于航班延誤,二者的適用對象、發(fā)生的時段存在差異。國際航空法和國內(nèi)航空法中未對航空運輸延誤的概念進行明確界定,司法實踐和學理研究中分別提出過“約定時間說”、“約定時間和合理期間說相結(jié)合”以及“分類標準說”,都力圖明晰航空運輸延誤的概念。以“分類標準說”為依據(jù)對航空運輸延誤的概念進行界定是合理的。航空運輸延誤是一種客觀事實,旅客運輸延誤應(yīng)從出發(fā)延誤和到達延誤兩個方面進行判斷;托運行李延誤應(yīng)堅持“行李隨人”的標準采用達到延誤進行判斷;貨物延誤的判斷標準應(yīng)根據(jù)托運人和承運人的約定采用到達延誤進行分析。航空運輸是一個系統(tǒng)工程,致使發(fā)生延誤的原因眾多,因此承擔責任的主體亦為多方主體。在承運人責任中,因天氣、軍事活動與空中交通管制及聯(lián)檢、機場、旅客與公共安全等承運人所不能控制的原因所生發(fā)的延誤是合理延誤,承運人無需承擔賠償責任;反之,因機械故障和航空公司自身原因致使延誤發(fā)生的,則為不合理延誤,承運人應(yīng)當承擔賠償責任。根據(jù)航空運輸?shù)男再|(zhì)不同來分別確定延誤賠償所適用的法律。國際上相關(guān)國家和地區(qū)對航空運輸延誤的規(guī)定有一定的借鑒意義,我國應(yīng)首先要完善立法,制定切實可行的航空運輸延誤判斷依據(jù)及承運人責任;其次,要加強空域管理體制改革,優(yōu)化空域資源的利用;再次,航空承運人應(yīng)為消費者提供更好的客戶體驗,完善延誤善后服務(wù)工作,航空運輸協(xié)會也應(yīng)加強事前管理和事后監(jiān)督作用;最后,應(yīng)完善航空運輸延誤險,實現(xiàn)快捷理賠。
[Abstract]:The delay in aviation law includes flight delay and air transport delay, and air transport delay is not equal to flight delay. The concept of delay in air transport has not been clearly defined in international air law and domestic air law, and the theory of "agreed time" has been put forward in judicial practice and theoretical research. The combination of the agreed time and reasonable period theory and the classification standard theory try to clarify the concept of air transport delay. It is reasonable to define the concept of air transport delay on the basis of classification standard theory. Air transportation delay is an objective fact, passenger transport delay should be judged from two aspects: departure delay and arrival delay; The judgment of delay shall be analysed according to the agreement of the shipper and carrier. Air transportation is a system engineering, which has many reasons for delay. In the carrier's responsibility, the delay caused by the weather, military activities and air traffic control and joint inspection, airport, passenger and public safety and other reasons beyond the carrier's control is reasonable delay, the carrier does not have to bear liability for compensation; On the other hand, if the delay occurs due to mechanical failure and airline's own reasons, it is unreasonable delay, and the carrier should be liable for compensation. The law applicable to delay compensation is determined according to the nature of air transport. Relevant countries and regions in the international air transport delay regulations have certain reference significance, our country should first perfect the legislation, formulate the feasible air transport delay judgment basis and carrier responsibility; Secondly, we should strengthen the reform of airspace management system and optimize the utilization of airspace resources. Thirdly, the air carrier should provide better customer experience for consumers, improve the service of delay and aftercare, and the air transport association should also strengthen the role of pre-management and post-supervision; finally, air transport delay risk should be improved to realize quick settlement of claims.
