【摘要】：我國《保險(xiǎn)法》對(duì)保險(xiǎn)利益的規(guī)定過于含糊,并沒有將人身保險(xiǎn)利益與財(cái)產(chǎn)保險(xiǎn)利益相區(qū)分。本文從保險(xiǎn)利益起源及發(fā)展出發(fā),對(duì)人身保險(xiǎn)利益的概念進(jìn)行界定,并對(duì)人身保險(xiǎn)利益的一般功能和社會(huì)功能進(jìn)行論述。同時(shí),在對(duì)英國、美國及我國臺(tái)灣地區(qū)法律及學(xué)者的觀點(diǎn)進(jìn)行總結(jié)和評(píng)析的基礎(chǔ)上,結(jié)合人身保險(xiǎn)合同自身的特點(diǎn),對(duì)涉及到人身保險(xiǎn)利益的兩個(gè)主要問題即人身保險(xiǎn)利益的主體效力和存在的時(shí)點(diǎn)的不同觀點(diǎn)進(jìn)行評(píng)析,最終得出唯受益人應(yīng)該受人身保險(xiǎn)利益的約束和應(yīng)根據(jù)人身保險(xiǎn)利益的來源,對(duì)人身保險(xiǎn)利益的存在的時(shí)點(diǎn)作出區(qū)別規(guī)定的觀點(diǎn)。進(jìn)而指出我國人身保險(xiǎn)立法中的不足之處,提出相關(guān)完善人身保險(xiǎn)利益規(guī)定的系列問題的建議,以期在一定程度上可以彌補(bǔ)我國人身保險(xiǎn)利益規(guī)定的缺憾。
[Abstract]:The insurance law of our country is too vague about insurance interests, and does not distinguish between life insurance interests and property insurance interests. Starting from the origin and development of insurance interests, this paper defines the concept of personal insurance interests, and discusses the general and social functions of personal insurance interests. At the same time, on the basis of summing up and evaluating the views of the British, American and Taiwan laws and scholars, and combining the characteristics of the personal insurance contract itself, This paper analyzes the two main issues concerning the interests of personal insurance, namely, the subjective effect of the interests of personal insurance and the different points of view of the existence of the interests of life insurance. Finally, it comes to the viewpoint that only beneficiary should be bound by the interests of personal insurance and should make a distinction between the points of existence of the interests of personal insurance according to the source of the interests of personal insurance. Furthermore, this paper points out the deficiencies in the legislation of personal insurance in China, and puts forward some suggestions on how to perfect the regulations on the interests of personal insurance in order to make up for the shortcomings of the regulations on the interests of life insurance in China to a certain extent.
