【摘要】：臺(tái)胞投資權(quán)益保護(hù)事關(guān)兩岸關(guān)系發(fā)展大局。大陸方面現(xiàn)行臺(tái)胞投資權(quán)益保護(hù)規(guī)定提供了臺(tái)胞投資權(quán)益保障的行為依據(jù),在保障臺(tái)胞投資權(quán)益方面發(fā)揮了重要作用。然而,關(guān)于臺(tái)胞投資權(quán)益保護(hù)的相應(yīng)規(guī)定中,臺(tái)胞居民待遇問(wèn)題尤為引人注目。臺(tái)胞投資領(lǐng)域的居民待遇問(wèn)題是實(shí)踐過(guò)程中的基礎(chǔ),其他規(guī)定的基石,同時(shí)也是對(duì)臺(tái)胞投資定位、分析以及正確處理的基本規(guī)定。但是,從臺(tái)胞投資最基礎(chǔ)的概念定義到法律體系,臺(tái)胞投資的居民待遇問(wèn)題都存在著很多缺陷,需要進(jìn)一步進(jìn)行完善。本文通過(guò)對(duì)歷史的梳理,探索臺(tái)胞投資居民待遇發(fā)展歷程、出臺(tái)背景,對(duì)國(guó)民及居民的詞源進(jìn)行深入探析,分析比較"國(guó)民"及"居民"的大小、異同,從而找出"國(guó)民待遇"與"居民待遇"的本質(zhì)區(qū)別,"比照外商"的名詞分析等角度,進(jìn)一步解析居民待遇的內(nèi)涵和外延,針對(duì)現(xiàn)存的法律體系存在的問(wèn)題提出自己針對(duì)性的完善建議,從而更好的實(shí)現(xiàn)臺(tái)胞在大陸投資問(wèn)題。
[Abstract]:The protection of investment rights and interests of Taiwan compatriots has a bearing on the overall situation of the development of cross-strait relations. The current regulations on the protection of investment rights and interests of Taiwan compatriots in mainland China provide the behavioral basis for the protection of investment rights and interests of Taiwan compatriots and play an important role in safeguarding the investment rights and interests of Taiwan compatriots. However, among the corresponding regulations on the protection of investment rights and interests of Taiwan compatriots, the issue of the treatment of residents of Taiwan compatriots is particularly noticeable. The issue of residents' treatment in the field of Taiwan compatriots' investment is the foundation of the practice process and the cornerstone of other regulations, and it is also the basic rule for the positioning, analysis and correct handling of Taiwan compatriots' investment. However, from the definition of the most basic concept of Taiwanese investment to the legal system, there are many defects in the treatment of residents invested by Taiwan compatriots, which need to be further improved. By combing the history, this paper explores the development course of the treatment of the residents invested by Taiwan compatriots, introduces the background, deeply analyzes the etymology of the people and the residents, and analyzes and compares the size, similarities and differences between "the people" and "the residents". In order to find out the essential difference between "national treatment" and "resident treatment", and to further analyze the connotation and extension of residents' treatment, Aiming at the problems existing in the existing legal system, the author puts forward his own suggestions to improve the investment of Taiwan compatriots in the mainland.
