論3D打印運動鞋的知識產(chǎn)權(quán)保護

【摘要】:3D打印給運動鞋制造領(lǐng)域帶來了革命性的變化,但同時也使得新型運動鞋面臨各種被侵權(quán)的風險。在數(shù)字建模階段,制造商需要通過版權(quán)法保護其產(chǎn)品設(shè)計圖;在生產(chǎn)制造階段,制造商需要通過專利法、商標法、反不正當競爭法來保護運動鞋中的技術(shù)方案、品牌標識和裝潢花式。3D打印技術(shù)同時也使得消費者很可能成為新的侵權(quán)者,這不但需要法律的相關(guān)調(diào)整,還需要制造企業(yè)提升自身的產(chǎn)品研發(fā)水平,從各種環(huán)節(jié)管控產(chǎn)品被仿造的風險。
[Abstract]:3D printing has revolutionized the field of sports shoe manufacturing, but it has also exposed new sports shoes to various risks of infringement. In the digital modeling phase, manufacturers need to protect their product designs through copyright laws; in manufacturing, manufacturers need to protect technical solutions in sneakers through patent laws, trademark laws, and anti-unfair competition laws.
