【摘要】：隨著時(shí)代的發(fā)展和社會(huì)的進(jìn)步,人們的生活方式悄悄的發(fā)生著變化,這些變化體現(xiàn)在人們的消費(fèi)方式中。人們習(xí)慣了“超市卡”溜進(jìn)錢包,熱衷于躋身“VIP白金卡會(huì)員”,享受著網(wǎng)絡(luò)預(yù)付購(gòu)物的新鮮和便捷,期盼著各城市即將推出的“城市綜合一卡通”�！邦A(yù)付式消費(fèi)”以多樣的形式,融入到社會(huì)生活的每一個(gè)角落,一方面給人們帶來(lái)便利、時(shí)尚的消費(fèi)方式,另一方面,因?yàn)槿狈ο鄳?yīng)制度和過(guò)于自由,預(yù)付式消費(fèi)發(fā)展也帶來(lái)了很多的問(wèn)題,給消費(fèi)者的及其他利益相關(guān)者的權(quán)益帶來(lái)了或輕或重的損失。近年來(lái),預(yù)付式消費(fèi)從強(qiáng)制消費(fèi),到合同欺詐拒不退款,到老板卷款跑路的事件頻繁發(fā)生,預(yù)付式消費(fèi)問(wèn)題已經(jīng)成為有目共睹的熱點(diǎn)問(wèn)題。政府現(xiàn)有監(jiān)管機(jī)制雖初步建立,但監(jiān)管仍存在“越位”、“缺位”、“錯(cuò)位”的問(wèn)題,監(jiān)管效力滯后、監(jiān)管政策存在漏洞、監(jiān)管機(jī)制運(yùn)行有偏差,效果不明顯。本研究試圖以我國(guó)政府對(duì)預(yù)付式消費(fèi)的監(jiān)管現(xiàn)狀為研究對(duì)象,應(yīng)用文獻(xiàn)研究法、比較分析法、實(shí)證與規(guī)范分析法等方法進(jìn)行研究,深入分析“預(yù)付式消費(fèi)”從政策制定本身、政策執(zhí)行過(guò)程,到反饋調(diào)整中存在的問(wèn)題；從重視程度、監(jiān)管機(jī)制、監(jiān)管情況、監(jiān)管效果四個(gè)方面對(duì)現(xiàn)有政府監(jiān)管情況進(jìn)行效用評(píng)價(jià),并對(duì)監(jiān)管中的不足從政策制定、監(jiān)管主體、監(jiān)管目標(biāo)群體、監(jiān)管環(huán)境等方面進(jìn)行原因的深挖。知不足而后能改,有針對(duì)性的提了建議,以提高政府監(jiān)管預(yù)付費(fèi)市場(chǎng)的效率和服務(wù)市場(chǎng)經(jīng)濟(jì)發(fā)展的滿意度。經(jīng)過(guò)分析,形成具有亮點(diǎn)的建議如下：第一、政府的監(jiān)管仍是目前解決預(yù)付消費(fèi)問(wèn)題的關(guān)鍵,政付標(biāo)桿作用是主流。第二、準(zhǔn)確的對(duì)問(wèn)題的制造者進(jìn)行定位,疏導(dǎo)滿足預(yù)付消費(fèi)相關(guān)群體訴求是解決問(wèn)題的關(guān)鍵點(diǎn)。第三、分析得出現(xiàn)有的政府監(jiān)管機(jī)制漏洞是發(fā)生問(wèn)題的誘因。第四、建立有效信用體系是提高政府監(jiān)管能力的重要平臺(tái)。第五、建議政府兜底監(jiān)管將責(zé)任“承擔(dān)到底”,通過(guò)建立社會(huì)救濟(jì)體系柔化損失,保障利益相關(guān)者尤其是消費(fèi)者權(quán)益。
[Abstract]:With the development of the times and the progress of the society, people's way of life is changing quietly, and these changes are reflected in the way people consume. People are used to "supermarket card" sneaking into the wallet, eager to join the "VIP platinum card members", enjoy the online prepaid shopping fresh and convenient, looking forward to the city will soon launch the "City Integrated Card." "prepaid consumption" is integrated into every corner of social life in various forms. On the one hand, it brings convenience and fashion to people, on the other hand, because of the lack of corresponding system and too much freedom, The development of prepaid consumption also brings a lot of problems and brings light or heavy losses to the rights and interests of consumers and other stakeholders. In recent years, prepaid consumption from forced consumption to contract fraud refused to refund, to the boss running away frequently, the issue of prepaid consumption has become a hot issue for everyone to see. Although the existing regulatory mechanism of the government is initially established, there are still problems of "offside", "absence" and "dislocation" in the supervision, the effectiveness of supervision is lagging behind, there are loopholes in the supervision policy, and the supervision mechanism has deviated from each other, and the effect is not obvious. This study attempts to study the current situation of our government's supervision of prepaid consumption, applies the methods of literature research, comparative analysis, empirical and normative analysis, and deeply analyzes "prepaid consumption" from the policy formulation itself. In the process of policy implementation to the problems in feedback adjustment, the paper evaluates the effectiveness of the existing government supervision from four aspects: the degree of attention, the supervision mechanism, the supervision situation, and the effect of supervision. The main body, target groups, regulatory environment and other aspects of the reasons. Some suggestions are put forward in order to improve the efficiency of government supervision of the prepaid market and the satisfaction of the development of the market economy. After analysis, the following suggestions are formed: first, the supervision of government is still the key to solve the problem of prepaid consumption, and the role of policy and payment benchmark is the mainstream. Secondly, the key to solve the problem is to locate the problem maker accurately and to meet the demands of prepaid consumption-related groups. Third, the analysis of the existing government regulatory mechanism loophole is the cause of the problem. Fourth, the establishment of an effective credit system is an important platform to improve the ability of government supervision. Fifthly, it is suggested that the government should "bear the responsibility to the end" by establishing a social relief system to protect the rights and interests of stakeholders, especially consumers.
