【摘要】："租售同權(quán)"結(jié)合中國國情,將租賃權(quán)這種民事權(quán)利和憲法上的平等權(quán)緊密聯(lián)系,可謂是其最大的法律亮點(diǎn)。"租售同權(quán)"的實(shí)現(xiàn)也可分為兩個(gè)層次:一是直接通過各種規(guī)范性文件賦予承租人在公共領(lǐng)域享有和房屋所有權(quán)人同等的權(quán)利。二是通過擴(kuò)大房源、支持租房租賃企業(yè)的發(fā)展等措施,促進(jìn)租賃市場的發(fā)展,從而擴(kuò)大租賃權(quán)主體,惠及更多人群。
[Abstract]:"the same right of lease and sale", combined with China's national conditions, closely links the civil right of lease right with the constitutional right of equality, which is the biggest legal highlight of the right. " The realization of the same right of lease and sale can also be divided into two levels: one is to grant the lessee the same rights in the public domain as the owner of the house directly through various normative documents. The second is to promote the development of the rental market by expanding the source of housing and supporting the development of rental enterprises, thus expanding the subject of lease rights and benefiting more people.
