反壟斷執(zhí)法主體問題研究

【摘要】:頒布《反壟斷法》是每一個(gè)市場經(jīng)濟(jì)國家維護(hù)自由競爭和統(tǒng)一市場經(jīng)濟(jì)秩序的必要手段。從2008年8月1日我國《反壟斷法》施行到現(xiàn)在已經(jīng)近10年,這部法律要得以貫徹適用,充分發(fā)揮其作用,執(zhí)法主體的合理設(shè)置是其中的關(guān)鍵因素之一。目前,在我國擁有反壟斷執(zhí)法權(quán)的機(jī)構(gòu)有商務(wù)部、發(fā)改委和工商總局。這三個(gè)機(jī)構(gòu)根據(jù)我國的《反壟斷法》、《價(jià)格法》和《反不正當(dāng)競爭法》等相關(guān)法律法規(guī)劃分其管轄范圍。然而問題也隨之而來,多頭管轄造成了在某些案件上會出現(xiàn)管轄權(quán)的沖突,即便我國在不斷完善《反壟斷法》的具體操作細(xì)則,但是在實(shí)際操作中這種設(shè)置模式的弊端還是越來越明顯。因此,我國應(yīng)該設(shè)計(jì)更加符合經(jīng)濟(jì)運(yùn)行規(guī)律和我國國情的反壟斷執(zhí)法主體的設(shè)置模式。此外,我國在應(yīng)對行政性壟斷的方面也存在不少問題,主要體現(xiàn)在我國的《反壟斷法》對于行政性壟斷的規(guī)定過于籠統(tǒng),沒有明確反行政性壟斷的執(zhí)法主體,致使我國反壟斷執(zhí)法主體偏重于經(jīng)濟(jì)性壟斷的處理,而對行政性壟斷的查處則依然保守。為此,我國反壟斷執(zhí)法主體應(yīng)當(dāng)把反行政性壟斷也作為重點(diǎn)工作,只有這樣才能讓《反壟斷法》在我國經(jīng)濟(jì)生活中得以真正的貫徹和落實(shí),確保良好的競爭和市場秩序。此外,在反壟斷執(zhí)法主體與行業(yè)監(jiān)管機(jī)構(gòu)的協(xié)調(diào)問題上,我國也沒有建立起一套成熟的協(xié)調(diào)機(jī)制,導(dǎo)致在執(zhí)法過程中反壟斷執(zhí)法主體與行業(yè)監(jiān)管機(jī)構(gòu)間的信息不對稱,造成管轄權(quán)和適用法律問題上的沖突。為完善我國的反壟斷執(zhí)法體系,我國應(yīng)當(dāng)建立起以反壟斷公權(quán)力為主,行業(yè)監(jiān)管為輔的反壟斷執(zhí)法主體的模式,相信科學(xué)的反壟斷執(zhí)法主體的設(shè)置會對我國的市場經(jīng)濟(jì)產(chǎn)生巨大的推動作用。
[Abstract]:The promulgation of the Antimonopoly Law is a necessary means for every market economy country to maintain free competition and unify the market economy order. It has been nearly 10 years since the "Anti-monopoly Law" was put into effect on August 1, 2008 in China. It is one of the key factors for this law to be fully applied and to give full play to its role. The rational setting of the subject of law enforcement is one of the key factors. At present, there are the Ministry of Commerce, the Development and Reform Commission and the General Administration of Industry and Commerce. These three institutions divide their jurisdiction according to the relevant laws and regulations such as the Anti-monopoly Law, the Price Law and the Anti-unfair Competition Law of China. However, the problem also follows that long jurisdiction causes conflicts of jurisdiction in some cases, even though our country is constantly perfecting the specific operating rules of the Anti-monopoly Law. But the malpractice of this kind of setting mode is more and more obvious in the actual operation. Therefore, our country should design the setting mode of antitrust law enforcement subject in accordance with the economic operation law and our country's national conditions. In addition, there are also many problems in dealing with administrative monopoly in our country, which are mainly reflected in the fact that the provisions of the Anti-monopoly Law on Administrative Monopoly are too general and do not specify the subject of law enforcement against administrative monopoly. As a result, the main body of anti-monopoly law enforcement in our country pays more attention to the treatment of economic monopoly, while the investigation and punishment of administrative monopoly is still conservative. Therefore, the main body of anti-monopoly law enforcement in our country should also take the anti-administrative monopoly as the key work. Only in this way can the Anti-monopoly Law be truly carried out and implemented in our country's economic life, and ensure good competition and market order. In addition, China has not established a set of mature coordination mechanism on the coordination between the subject of anti-monopoly law enforcement and the industry supervision agency, which leads to the asymmetry of information between the subject of anti-monopoly law enforcement and the industry supervision agency in the course of law enforcement. Conflict of jurisdiction and applicable law. In order to perfect the anti-monopoly law enforcement system of our country, we should set up the anti-monopoly law enforcement main body mode, which is based on anti-monopoly public power and supplemented by industry supervision. It is believed that the establishment of scientific anti-monopoly law enforcement subject will greatly promote the market economy of our country.
