【摘要】：隨著郵輪旅游在我國(guó)的興起,外資的郵輪公司紛紛進(jìn)駐中國(guó)市場(chǎng),越來(lái)越多的中國(guó)內(nèi)地居民選擇郵輪旅游作為節(jié)假日休閑娛樂(lè)的方式,由中國(guó)公司自主經(jīng)營(yíng)的郵輪產(chǎn)品也開(kāi)始嶄露頭角,郵輪旅游在帶來(lái)豐厚經(jīng)濟(jì)回報(bào)和極大地豐富了我國(guó)內(nèi)地居民休閑生活的同時(shí),也給郵輪經(jīng)營(yíng)人產(chǎn)生了極大的責(zé)任風(fēng)險(xiǎn)。中國(guó)擁有龐大的旅游消費(fèi)市場(chǎng),與這種日益增長(zhǎng)的消費(fèi)需求相比,中國(guó)的郵輪產(chǎn)業(yè)卻尚未成熟,相關(guān)的配套法律法規(guī)制度等也并沒(méi)有跟進(jìn)。郵輪經(jīng)營(yíng)人與傳統(tǒng)的船舶所有人、經(jīng)營(yíng)人相比,要承擔(dān)更多公共責(zé)任,但目前中國(guó)的航運(yùn)保險(xiǎn)業(yè)特別針對(duì)郵輪經(jīng)營(yíng)責(zé)任的保險(xiǎn)產(chǎn)品仍是一片空白。本文在研究過(guò)程中,進(jìn)行了充分的市場(chǎng)調(diào)研,并運(yùn)用了語(yǔ)義分析方法、比較法研究方法、邏輯實(shí)證分析方法等法學(xué)研究方法。內(nèi)容上,首先對(duì)郵輪經(jīng)營(yíng)人的性質(zhì)和責(zé)任在現(xiàn)有的法律規(guī)制下進(jìn)行了分析和界定,將其與傳統(tǒng)的客運(yùn)承運(yùn)人和旅游經(jīng)營(yíng)人相區(qū)分。然后對(duì)市場(chǎng)上郵輪經(jīng)營(yíng)人現(xiàn)有的責(zé)任保險(xiǎn)產(chǎn)品介紹的同時(shí),得出其無(wú)法應(yīng)對(duì)郵輪經(jīng)營(yíng)人巨大的責(zé)任風(fēng)險(xiǎn)的結(jié)論。航運(yùn)經(jīng)營(yíng)主體的責(zé)任保險(xiǎn)一直是海上保險(xiǎn)中的研究重點(diǎn),在國(guó)際公約和各國(guó)立法中對(duì)郵輪經(jīng)營(yíng)人責(zé)任要求越來(lái)越重的趨勢(shì)下,本文提出構(gòu)建強(qiáng)制責(zé)任保險(xiǎn),鼓勵(lì)設(shè)立自保公司,并提供了相應(yīng)的制度設(shè)計(jì)建議,以求能為解決郵輪旅游市場(chǎng)上的諸多風(fēng)險(xiǎn)提供良方,對(duì)促進(jìn)我國(guó)郵輪產(chǎn)業(yè)的良好發(fā)展略盡綿力。
[Abstract]:With the rise of cruise tourism in China, foreign cruise companies have entered the Chinese market one after another. More and more mainland Chinese residents choose cruise tourism as a way of leisure and entertainment during holidays. Cruise products, which are operated independently by Chinese companies, are also coming to the fore. Cruise tourism not only brings rich economic returns and greatly enriches the leisure life of mainland residents in our country, but also brings great liability risks to cruise operators. China has a huge tourist consumption market, compared with this growing consumer demand, China's cruise industry is not yet mature, related laws and regulations have not been followed. Compared with the traditional ship owners and operators, the cruise operators have to bear more public responsibilities, but at present, China's shipping insurance industry is still a blank. In the course of the research, this paper has carried on the sufficient market research, and has used the semantic analysis method, the comparative method research method, the logic demonstration analysis method and so on law research method. Firstly, the author analyzes and defines the nature and responsibility of cruise operators under the existing legal regulations, and distinguishes them from the traditional passenger carriers and tour operators. Then the paper introduces the existing liability insurance products of cruise operators in the market and draws the conclusion that they can not cope with the huge liability risks of cruise operators. The liability insurance of shipping operators has been the focus of marine insurance research. Under the trend that the liability requirements of cruise operators are becoming more and more serious in international conventions and national legislations, this paper proposes to construct compulsory liability insurance to encourage the establishment of self-insurance companies. In order to solve the many risks in the cruise tourism market and promote the good development of the cruise industry in China, this paper provides some suggestions for the design of the corresponding system in order to provide a good solution to the risks in the cruise tourism market.
