我國汽車產(chǎn)品召回法律制度研究

【摘要】：在1966年的時候，美國將缺陷汽車產(chǎn)品的召回了入了國家法律調(diào)整的范圍，之后得到了大力的推廣與發(fā)展，迄今為止，已有2億多輛汽車被召回。而我國的此項法律制度正式啟動于2004年，起步尚晚。我國出臺的《缺陷汽車產(chǎn)品召回管理條例》已于2013年1月1日起開始正式施行了。汽車產(chǎn)品召回法律制度的法律位階得到了提高，由部門規(guī)章即《缺陷汽車產(chǎn)品召回管理規(guī)定》升級到了行政法規(guī)即《缺陷汽車產(chǎn)品召回管理條例》，由此可以看出我國政府對于保護汽車消費有著將要使它保持健康穩(wěn)步長久發(fā)展的決心，還有著要運用法治手段將汽車產(chǎn)品質(zhì)量進行提升、將良性競爭秩序構(gòu)建起來從而能盡快從汽車大國向汽車強國轉(zhuǎn)變的戰(zhàn)略意圖。法律位階的提高，代表著汽車產(chǎn)品召回的法律制度取得了一個飛躍性的進步。 本文的主要內(nèi)容有：首先對缺陷汽車召回法律制度進行概述，，包括沿革、相關(guān)定義和主要內(nèi)容；然后結(jié)合新出臺的《缺陷汽車產(chǎn)品召回管理條例》來論述汽車召回法律制度的現(xiàn)狀并對其法律制度進行分析；最后針對我國缺陷汽車召回法律制度提出建議。 在汽車產(chǎn)業(yè)蓬勃發(fā)展的形式下，本文具有重要的現(xiàn)實意義。本文將著重探析如何構(gòu)建和完善相關(guān)的法律規(guī)范，希望在加強保護消費者人身、財產(chǎn)安全和社會公共利益安全的同時，能夠正確有效的促進我國經(jīng)濟的全面協(xié)調(diào)可持續(xù)發(fā)展。
[Abstract]:In 1966, the United States recalled defective automobile products into the scope of national legal adjustment, and has been vigorously promoted and developed. So far, more than 200 million vehicles have been recalled. The legal system of our country officially started in 2004, the start is still late. The Regulation of defective Automobile Product recall has been put into effect since January 1, 2013. The legal order of the legal system of recall of automobile products has been raised. From the departmental regulations, that is, the "regulations on the recall of defective Automobile products", upgraded to the administrative regulations, that is, the "regulations on the recall of defective Automobile products", it can be seen that the government of our country will keep healthy for the protection of automobile consumption. Kang's determination to develop steadily and for a long time, There is also a strategic intention to improve the quality of automobile products by means of the rule of law and to construct a healthy competition order so as to transform from a big automobile country to a powerful automobile country as soon as possible. The improvement of legal rank represents that the legal system of automobile product recall has made a leap forward. The main contents of this paper are as follows: firstly, the legal system of defective automobile recall is summarized, including the history, relevant definitions and main contents; Then it discusses the current situation of the legal system of defective automobile recall and analyzes its legal system in combination with the new Regulation of defective Automobile recall, and finally puts forward some suggestions for the legal system of defective automobile recall in China. In the form of vigorous development of automobile industry, this paper has important practical significance. This article will focus on how to construct and improve the relevant legal norms, hoping to strengthen the protection of consumer, property safety and social and public interest security, while correctly and effectively promoting the overall coordinated and sustainable development of China's economy.
