【摘要】：在科學(xué)與技術(shù)理性標(biāo)準(zhǔn)的指導(dǎo)下,民國(guó)政府開始自西方全面移植商品檢驗(yàn)法。因個(gè)人工作方法而頗具影響力的上海商品檢驗(yàn)局,和深受政治斗爭(zhēng)與地方關(guān)系影響的廣州商品檢驗(yàn)局在對(duì)待檢政上的不同態(tài)度,導(dǎo)致了民國(guó)商品檢驗(yàn)法在南北地域上的實(shí)施差異。因參與者的性格和眼界、執(zhí)法部門的利益之爭(zhēng)等不同因素所體現(xiàn)出的完全不同的法制觀念和執(zhí)法行動(dòng),反映了以民國(guó)商品檢驗(yàn)法為代表的國(guó)民黨政府統(tǒng)治時(shí)期在科學(xué)和政治的影響下法律移植的困境與機(jī)遇。
[Abstract]:Under the guidance of scientific and technological rationality standards, the Republic of China government began to transplant commodity inspection methods from the West. The Shanghai Commodity Inspection Bureau, which has considerable influence on its personal working methods, and the Guangzhou Commodity Inspection Bureau, which is deeply influenced by political struggles and local relations, have different attitudes towards the procuratorial administration. Led to the Republic of China commodity inspection law in the north and south of the implementation of the difference. Because of different factors such as the personality and vision of the participants, the competing interests of the law enforcement agencies, and other factors, such as completely different legal concepts and law enforcement actions, It reflects the difficulties and opportunities of law transplantation under the influence of science and politics during the period of the Kuomintang government's rule, represented by the Commodity Inspection Law of the Republic of China.
