【摘要】：以電商交易、餐飲外賣、出行應(yīng)用和互聯(lián)網(wǎng)系統(tǒng)為代表的網(wǎng)絡(luò)刷單嚴(yán)重擾亂了正常的市場交易秩序,有必要對其進行法律分析。經(jīng)營者的非理性博弈、平臺的自利性縱容、消費者的搭便車心理都在一定程度上加劇了這一現(xiàn)象。刷單作為互聯(lián)網(wǎng)領(lǐng)域的新型不法行為,通常應(yīng)由反不正當(dāng)競爭法、消費者權(quán)益保護法和互聯(lián)網(wǎng)交易管理辦法進行規(guī)制。要有效落實炒單刷信者的法律責(zé)任,應(yīng)當(dāng)在"軟法"與"硬法"的二元結(jié)構(gòu)中,在平臺自律、行業(yè)調(diào)制與國家強制的三維視域下,依照社會規(guī)范和法律的有關(guān)規(guī)定,確鑿落實行為人民事、刑事與行政等多個方面的責(zé)任。
[Abstract]:E-commerce, food takeout, travel application and Internet system have seriously disturbed the normal order of market transactions, it is necessary to carry out legal analysis. The irrational game of the operator, the self-indulgence of the platform and the free-rider psychology of the consumers all aggravate this phenomenon to a certain extent. As a new illegal act in the field of Internet, bill brushing should usually be regulated by anti-unfair competition law, consumer rights and interests protection law and Internet transaction management. In order to effectively carry out the legal responsibility of the fiduciary, we should, in the dualistic structure of "soft Law" and "hard Law" and under the three dimensional vision of platform self-discipline, industry modulation and state compulsion, in accordance with the social norms and the relevant provisions of the law, Concrete implementation of the actor's civil, criminal and administrative responsibilities in many aspects.
