【摘要】：電子空運(yùn)單是近年來才興起的一種運(yùn)輸單證,區(qū)別于紙質(zhì)單證之處在于其載體電子化,傳遞方式電子化,快捷化,因而為承運(yùn)人及貨主所青睞。但是,電子空運(yùn)單作為一種新穎的事物,其性質(zhì)、作用等均與紙質(zhì)單證存在差異。采用電子空運(yùn)單的單證形式時(shí)合同生效的時(shí)間與采用紙質(zhì)單證時(shí)亦有不同。文章比較了電子空運(yùn)單制度與紙質(zhì)空運(yùn)單制度的區(qū)別,分析了電子空運(yùn)單對航空貨運(yùn)合同的影響,指出電子空運(yùn)單制度下合同訂立、成立及生效與紙質(zhì)空運(yùn)單的差異,討論了依據(jù)電子空運(yùn)單識(shí)別承運(yùn)人等主體的標(biāo)準(zhǔn),據(jù)此提出建構(gòu)我國電子空運(yùn)單制度的建議。文章的第一部分闡述了電子空運(yùn)單的現(xiàn)狀,分別闡述了紙質(zhì)空運(yùn)單向電子空運(yùn)單轉(zhuǎn)化的商業(yè)基礎(chǔ)和法律基礎(chǔ);第二部分闡述了電子空運(yùn)單制度缺乏相關(guān)的法律保障,不能滿足實(shí)踐的需要,電子空運(yùn)單制度滯后于貨物運(yùn)輸事業(yè)的發(fā)展,不利于航空貨物運(yùn)輸業(yè)的健康發(fā)展;第三部分主要是通過電子空運(yùn)單制度和紙質(zhì)空運(yùn)單制度進(jìn)行比較,探究電子空運(yùn)單和紙質(zhì)空運(yùn)單關(guān)于合同要約、承諾、成立的形式不同,相應(yīng)的法律制度存在缺陷等問題,這些問題沒有完善的法律制度對其進(jìn)行規(guī)范,存在法律空白。第四部分主要闡述了電子空運(yùn)單與紙質(zhì)空運(yùn)單相比存在著很多的特殊性,所以導(dǎo)致相關(guān)主體的權(quán)利和義務(wù)存在差異,針對這些差異,闡明法律制度存在的缺陷。第五部分則是針對以上各部分中存在的法律缺陷,結(jié)合我國的實(shí)際情況,闡明我國電子空運(yùn)單制度的法律問題,并且提出完善意見。
[Abstract]:Electronic air waybill is a kind of transport document which has just arisen in recent years. It is different from paper document in that its carrier is electronic, transmission mode is electronic and quick, so it is favored by carrier and cargo owner. However, electronic air waybill as a novel thing, its properties, functions and so on are different from paper documents. The date of entry into force of the contract in the form of an electronic air waybill is different from that of a paper document. This paper compares the differences between electronic air waybill system and paper air waybill system, analyzes the influence of electronic air waybill on air cargo contract, and points out the difference between the conclusion, establishment and validity of contract under electronic air waybill system and paper air waybill. This paper discusses the criteria of identifying carriers and other subjects according to electronic air waybill, and puts forward some suggestions for constructing the electronic air waybill system in China. The first part of the article expounds the current situation of electronic air waybill, respectively, the commercial basis and legal basis of paper air transport one-way electronic air waybill transformation, the second part expounds the lack of relevant legal protection of electronic air waybill system. Unable to meet the needs of practice, the electronic air waybill system lags behind the development of the cargo transport industry, which is not conducive to the healthy development of the air cargo transport industry. The third part mainly compares the electronic air waybill system with the paper-based air waybill system. This paper probes into the problems of contract offer, acceptance, form of establishment, defects in corresponding legal system and so on. These problems are not regulated by perfect legal system, and there are legal gaps. The fourth part mainly elaborated the electronic air waybill has many particularities compared with the paper air waybill, therefore causes the related subject's rights and the obligation to have the difference, in the light of these differences, clarifies the legal system existence flaw. The fifth part is aimed at the legal defects in the above parts, combined with the actual situation of our country, it clarifies the legal problems of our country's electronic air waybill system, and puts forward some suggestions on how to improve it.
