【摘要】：近年來我國旅游業(yè)發(fā)展迅速,旅游業(yè)從新的經濟增長點成長為國民經濟支柱產業(yè),我國也從旅游資源大國轉變?yōu)槭澜缏糜未髧�。旅游業(yè)健康發(fā)展對推動國家經濟發(fā)展起到了巨大的作用。但在當前國內旅游業(yè)過程中,部分旅游企業(yè)不規(guī)范經營行為、行業(yè)經營秩序混亂仍比較突出,零負團費、強迫消費、旅游安全、虛假廣告、惡性競爭、甩客等問題屢禁不止�！堵糜畏ā返念C布實施,是維護旅游行業(yè)經營者合法利益、保護旅游者權利的必然要求,《旅游法》的頒布實施一年以來,以往旅游行業(yè)中存在損害旅游者利益的行為得到有效遏制。本文對《旅游法》中有關旅游者權利的重點條文逐條解讀,并輔之以案例進行分析說明�？偨Y國外旅游相關法律中關于旅游者權利義務的規(guī)定,在結合每個國家具體情況上進行分析,提煉出對我國旅游業(yè)發(fā)展有益的內容和方法�！堵糜畏ā奉C布實施是我國旅游史上的一個里程碑,法律的制定需要考慮多方面因素,法律的執(zhí)行則考驗各方面的能力,制定一部好的法律難,更難的是把好法律執(zhí)行貫徹好。雖然《旅游法》實施之初對一些突出的問題起到了立竿見影的效果,但經過觀察和相關統(tǒng)計數據分析,還是有一些問題沒能得到徹底根治,也有部分問題以新的形式出現,侵犯旅游者權利的事件依然時有發(fā)生。分析可知,這其中的原因包括法律實施的不徹底,旅游從業(yè)人員沒能領會和堅決貫徹《旅游法》精神,旅游主管部門的監(jiān)督、管理沿用老方式老方法的慣性問題,旅游者維權知識和意識的缺乏�！堵糜畏ā返呢瀼貙嵤┲挥型ㄟ^更廣泛的宣傳、教育,才能使旅游企業(yè)和從業(yè)人員規(guī)范自己的行為,行政管理部門嚴格履行監(jiān)督管理義務,旅游者運用多種方式合理維權,才能使旅游者權利得到更好保護。
[Abstract]:In recent years, China's tourism industry has developed rapidly, the tourism industry has grown from a new economic growth point to a pillar industry of the national economy, and China has also changed from a large country of tourism resources to a large country of tourism in the world. The healthy development of tourism has played a great role in promoting the national economic development. However, in the current process of domestic tourism, some tourism enterprises do not regulate their business behavior, and the confusion in the business order of the industry is still quite prominent, with zero and negative group fees, forced consumption, tourism safety, false advertising, and vicious competition. The promulgation and implementation of the "Tourism Law" is an inevitable requirement for safeguarding the legitimate interests of the operators of the tourism industry and protecting the rights of tourists. Since the promulgation and implementation of the "Tourism Law" one year ago, In the past, the behavior of harming the interests of tourists in the tourism industry has been effectively curbed. This paper interprets the key articles about tourist rights in Tourism Law, and explains them by case analysis. Summing up the foreign tourism related laws on the rights and obligations of tourists, in the light of the specific circumstances of each country to carry out an analysis, The promulgation and implementation of the Tourism Law is a milestone in the history of tourism in China. The formulation of the law requires consideration of various factors, and the enforcement of the law tests the ability of all sides. It is difficult to formulate a good law, but even more difficult to enforce it well. Although the "Tourism Law" has had an immediate effect on some outstanding problems at the beginning of its implementation, through observation and analysis of relevant statistical data, there are still some problems that have not been completely cured, and some problems have appeared in new forms. Violations of tourists' rights continue to occur from time to time. The analysis shows that the reasons include the incomplete implementation of the law, the failure of the tourism practitioners to grasp and resolutely implement the spirit of the "Tourism Law", the supervision of the tourism department in charge, and the inertia of the old ways and methods of management. Only through more extensive publicity and education can tourism enterprises and employees standardize their own behavior, and administrative departments strictly fulfill their duties of supervision and administration. In order to protect tourists' rights better, tourists can use various ways to protect their rights.
