互聯(lián)網(wǎng)虛假廣告法律規(guī)制研究

【摘要】:1994年我國開啟了互聯(lián)網(wǎng)時(shí)代,1997年我國產(chǎn)生了第一個(gè)互聯(lián)網(wǎng)廣告,之后互聯(lián)網(wǎng)廣告經(jīng)濟(jì)在中國飛速發(fā)展,互聯(lián)網(wǎng)虛假廣告也隨之而生,對(duì)傳統(tǒng)的廣告管理制度產(chǎn)生了巨大沖擊。目前國內(nèi)缺少專門的互聯(lián)網(wǎng)廣告立法,現(xiàn)存《廣告法》對(duì)層出不窮的新形式的網(wǎng)絡(luò)虛假廣告在定性上存在障礙,沒有專門的廣告監(jiān)督管理機(jī)關(guān)、監(jiān)管體制混亂,導(dǎo)致互聯(lián)網(wǎng)虛假廣告數(shù)量居高不下,廣告市場(chǎng)競(jìng)爭(zhēng)秩序和公平交易秩序被嚴(yán)重破壞,一大批事關(guān)消費(fèi)者生命健康的互聯(lián)網(wǎng)虛假廣告產(chǎn)生了很大的社會(huì)危害性,同時(shí)我國《刑法》222條規(guī)定的虛假廣告罪本身也存在著很大缺陷,導(dǎo)致對(duì)虛假廣告特別是互聯(lián)網(wǎng)虛假廣告的刑事規(guī)制力度不足。本文首先對(duì)互聯(lián)網(wǎng)虛假廣告現(xiàn)狀做了論述,進(jìn)而根據(jù)其自身區(qū)別于傳統(tǒng)廣告的特點(diǎn),提出通過立法設(shè)置《互聯(lián)網(wǎng)廣告法》作為《廣告法》的特別法這一建議,另外從刑事規(guī)制角度對(duì)如何控制互聯(lián)網(wǎng)虛假廣告提出了自己的看法。全文以互聯(lián)網(wǎng)虛假廣告為研究對(duì)象包括以下幾大部分:第一部分是對(duì)互聯(lián)網(wǎng)虛假廣告的現(xiàn)狀進(jìn)行了梳理。重點(diǎn)放在互聯(lián)網(wǎng)虛假廣告的概念、特征、類型的介紹上。第二部分分析了我國對(duì)互聯(lián)網(wǎng)虛假廣告的法律規(guī)制現(xiàn)狀以及存在的不足之處。以法律效力等級(jí)分層次研究相關(guān)立法現(xiàn)狀。第三部分介紹了域外關(guān)于互聯(lián)網(wǎng)虛假廣告的相關(guān)立法。主要涉及英美法系的美國、英國,大陸法系的日本、德國的相關(guān)立法。第四部分論述了加強(qiáng)互聯(lián)網(wǎng)虛假廣告刑事規(guī)制的必要性。首先,介紹互聯(lián)網(wǎng)虛假廣告的危害性;其次,介紹現(xiàn)有關(guān)于虛假廣告的行政處罰存在的缺陷,最后從不違背刑法的謙抑性原則這個(gè)角度論述加強(qiáng)對(duì)互聯(lián)網(wǎng)虛假廣告進(jìn)行刑事規(guī)制的必要性。第五部分重點(diǎn)在對(duì)現(xiàn)行《中華人民共和國刑法》規(guī)定的虛假廣告罪進(jìn)行完善。主要從主體范圍的擴(kuò)展,對(duì)法益的明確,對(duì)客觀構(gòu)成要件的補(bǔ)充、法定刑完善這幾個(gè)方面進(jìn)行的。
[Abstract]:In 1994, our country opened the Internet age, in 1997 our country produced the first Internet advertisement, after the Internet advertisement economy developed at full speed in China, the Internet false advertisement also came into being, which had a huge impact on the traditional advertising management system. At present, there is a lack of special Internet advertising legislation in our country. The existing advertising law has obstacles to the qualitative nature of the endless new forms of false advertisements on the Internet. There is no specialized advertising supervision and administration agency, and the regulatory system is chaotic. As a result of the high number of false advertisements on the Internet, the order of competition and fair trade in the advertising market has been seriously damaged, and a large number of false advertisements on the Internet, which are related to the lives and health of consumers, have caused great social harm. At the same time, the crime of false advertisement, which is stipulated in Article 222 of Criminal Law of our country, also has great defects, which leads to the lack of criminal regulation on false advertisement, especially on the Internet. This paper first discusses the current situation of false advertising on the Internet, and then, according to the characteristics of its own difference from the traditional advertising, puts forward the proposal of setting up the Internet Advertising Law as the special law of the Advertising Law through legislation. In addition, from the angle of criminal regulation, the author puts forward his own views on how to control the false advertising on the Internet. The thesis includes the following parts: the first part is about the status quo of Internet false advertising. Focus on the concept of false advertising on the Internet, features, types on the introduction. The second part analyzes the current situation and shortcomings of China's legal regulation of Internet false advertising. To study the current situation of relevant legislation in the level of legal effect. The third part introduces the relevant legislation about internet false advertisement. Mainly related to the Anglo-American law system of the United States, the United Kingdom, the civil law system of Japan, Germany related legislation. The fourth part discusses the necessity of strengthening the criminal regulation of Internet false advertising. First of all, it introduces the harmfulness of false advertising on the Internet; secondly, it introduces the defects of the existing administrative punishment on false advertising. Finally, from the point of view of not violating the principle of modesty of criminal law, this paper discusses the necessity of strengthening the criminal regulation of false advertisements on the Internet. The fifth part focuses on perfecting the crime of false advertisement stipulated in the Criminal Law of the people's Republic of China. Mainly from the expansion of the scope of the subject, the legal interests of the clear, the objective elements of the supplement, legal penalties to improve these aspects.
