【摘要】:民間借貸指的是在社會個人、企業(yè)及其他組織之間發(fā)生的活動,主要以貨幣資金為標(biāo)準進行價值讓渡,并采取本息償付的方式。一般講民間借貸,我們均將其范圍局限于民事行為,主要是發(fā)生于自然人、法人及其他組織之間一種借貸民事行為,且將金融機構(gòu)的借貸排除在外。從這個意義上而言,民間借貸是金融機構(gòu)借貸的一種補充形式。與此同時,民間借貸作為一種重要的配置手段,在很多方面發(fā)揮著較為重要的作用,比如補充資金不足、合理配置資源以及促進經(jīng)濟發(fā)展等等。但是絕大多數(shù)事情均是具有兩面性的,民間借貸給社會帶來好處的同時,也給人們的經(jīng)濟社會生活產(chǎn)生不好的影響。在解決不好影響的過程中,政府以及立法機關(guān)的角色十分重要,政府要積極認識到民間借貸監(jiān)管的缺失,立法機關(guān)應(yīng)及時跟上社會變遷,制定并完善更多合乎現(xiàn)狀的法律制度。進而實現(xiàn)在正規(guī)金融機構(gòu)與民間借貸之間,讓資金在同等條件下進行合理分布,引導(dǎo)和規(guī)范民間發(fā)展勢在必行。在引言部分,筆者從國外民間借貸法律規(guī)制與我國民間借貸法律規(guī)制入手,介紹本選題緣由,同時重點介紹美國、德國以及日本三國民間借貸法律規(guī)制的基本制度,引出我國民間借貸法律規(guī)制的未來發(fā)展趨勢。在第二章,筆者從民間借貸的理論與類型入手分析,重點探討民間借貸生成原因與現(xiàn)實類型,并探討我國立法現(xiàn)狀下民間借貸的概念。在第三章,筆者從民間借貸的積極影響與消極影響兩個層面,闡述完善我國民間借貸法律規(guī)制對我國社會及經(jīng)濟發(fā)展的重要意義所在。在第四章,筆者從政府監(jiān)管、刑法規(guī)制以及民法規(guī)范等三個層面探討民間借貸的法律規(guī)制現(xiàn)狀。在第五章,從行政法、民法以及刑法三個層面分別提出完善民間借貸監(jiān)管體系、完善民間借貸基本法律制度以及加強刑事規(guī)制三個策略。
[Abstract]:Private lending refers to the activities that occur between social individuals, enterprises and other organizations, which mainly use monetary funds as the standard for the transfer of value and the way of repayment of principal and interest. Generally speaking, the scope of private lending is limited to civil conduct, mainly occurs between natural persons, legal persons and other organizations, and excludes the lending of financial institutions. In this sense, private lending is a supplementary form of lending by financial institutions. At the same time, as an important means of allocation, private lending plays a more important role in many aspects, such as insufficient supplementary funds, rational allocation of resources and promotion of economic development. But most of the things have two sides, folk loans bring benefits to the society, but also to people's economic and social life has a bad impact. In the process of solving the bad influence, the role of the government and the legislature is very important. The government should actively recognize the lack of the supervision of private lending, and the legislature should keep up with the social changes in time, and formulate and improve more legal systems in line with the status quo. Therefore, it is imperative to realize the rational distribution of funds between the formal financial institutions and private loans under the same conditions, and to guide and standardize the development of the private sector. In the foreword part, the author starts with the legal regulation of foreign folk loan and our country's folk loan, introduces the reason of this topic, and introduces the basic system of the three countries of America, Germany and Japan. Leads to our country folk loan law regulation the future development tendency. In the second chapter, the author analyzes the theory and types of folk lending, focuses on the reasons for the formation of private lending and the actual types, and discusses the concept of folk lending under the current legislative situation of our country. In the third chapter, the author expounds the significance of perfecting the legal regulation of folk lending to the social and economic development of our country from the two aspects of the positive and negative effects of private lending. In the fourth chapter, the author discusses the current situation of the legal regulation of private lending from three aspects: government supervision, criminal law regulation and civil law regulation. In the fifth chapter, from the three levels of administrative law, civil law and criminal law, the author puts forward three strategies: perfecting the supervision system of folk loan, perfecting the basic legal system of folk loan and strengthening the criminal regulation.
