【摘要】：國有企業(yè)具有特殊的使命,理解公平競爭審查基本原則時應(yīng)對此加以考慮,尤其應(yīng)處理好"競爭優(yōu)先"與"競爭中立"的關(guān)系。某些國有企業(yè)具有行政管理職能,可以成為公共政策制定者,因此會成為公平競爭審查的責(zé)任主體,在此情形下實施公平競爭審查應(yīng)注意審查方式的選擇,將國有企業(yè)的自我審查和競爭執(zhí)法機構(gòu)的外部監(jiān)督結(jié)合起來。國有企業(yè)有可能受到公共政策的專向性特殊對待,這應(yīng)納入公平競爭審查制度的覆蓋范圍,同時也要求在實施公平競爭審查時給予特別考慮:一是在實體標(biāo)準(zhǔn)上應(yīng)以合法性標(biāo)準(zhǔn)為核心,以合理性標(biāo)準(zhǔn)為補充;二是在審查程序上應(yīng)借助利害關(guān)系人參與機制,發(fā)揮利害關(guān)系人的監(jiān)督制衡作用。
[Abstract]:State-owned enterprises have a special mission, which should be taken into account when understanding the basic principle of fair competition review, especially the relationship between "competition priority" and "competition standing". Some state-owned enterprises have administrative functions and can become public policy makers, so they will become the responsible subject of fair competition review. In this case, we should pay attention to the choice of examination mode in the implementation of fair competition review. Combine self-censorship of state-owned enterprises with external supervision of competition enforcement agencies. State-owned enterprises may be specially treated by public policies, which should be covered by the fair competition review system. It is also requested that special consideration be given to the implementation of a fair competition review: first, the substantive standard should be based on the criterion of legality, supplemented by the criterion of reasonableness; and, in the review process, the mechanism of stakeholder participation should be used, Give play to the interests of the supervision and checks and balances.
