【摘要】：隨著互聯(lián)網(wǎng)的發(fā)展,越來(lái)越多的企業(yè)采用雙邊市場(chǎng)進(jìn)行運(yùn)營(yíng),這種特殊的經(jīng)營(yíng)模式給以產(chǎn)業(yè)組織理論為經(jīng)濟(jì)學(xué)基礎(chǔ)的反壟斷分析帶來(lái)全新分析視角的同時(shí),也帶來(lái)巨大挑戰(zhàn),適用單邊市場(chǎng)的傳統(tǒng)工具和新興方法能否應(yīng)用于雙邊市場(chǎng)將是個(gè)嚴(yán)重的問(wèn)題。司法實(shí)踐中不斷出現(xiàn)的新的案例急需理論研究予以回應(yīng)。本文導(dǎo)論部分先提出問(wèn)題,然后闡述了選題背景和研究意義,對(duì)現(xiàn)有法律規(guī)定及研究成果進(jìn)行了評(píng)述,闡明國(guó)內(nèi)外研究現(xiàn)狀與發(fā)展趨勢(shì)。正文分為以下四個(gè)部分：第一章,雙邊市場(chǎng)的基本理論,簡(jiǎn)要介紹了雙邊市場(chǎng)的概念,分析雙邊市場(chǎng)交叉網(wǎng)絡(luò)外部性、平臺(tái)兩端定價(jià)機(jī)制不同、用戶鎖定降低需求替代性分析的三個(gè)特點(diǎn)。第二章,相關(guān)市場(chǎng)界定的一般理論,介紹了相關(guān)市場(chǎng)的概念和相關(guān)市場(chǎng)界定是需要考慮的三個(gè)維度,相關(guān)市場(chǎng)界定常用的替代性分析方法和SSNIP測(cè)試。第三章,雙邊市場(chǎng)下互聯(lián)網(wǎng)產(chǎn)業(yè)相關(guān)市場(chǎng)界定的困境。圍繞互聯(lián)網(wǎng)產(chǎn)業(yè)相關(guān)市場(chǎng)界定都能夠是否需要考慮雙邊市場(chǎng)、相關(guān)地域市場(chǎng)和SSNIP測(cè)試在雙邊市場(chǎng)條件下失效的問(wèn)題,從理論和實(shí)踐角度歸納總結(jié)相關(guān)市場(chǎng)界定面臨困境。第四章,雙邊市場(chǎng)條件下互聯(lián)網(wǎng)產(chǎn)業(yè)相關(guān)市場(chǎng)界定的出路。圍繞模糊相關(guān)市場(chǎng)界定、改進(jìn)SSNIP測(cè)試、重視互聯(lián)網(wǎng)相關(guān)地域市場(chǎng)、引入雙邊市場(chǎng)思路對(duì)雙邊市場(chǎng)下的互聯(lián)網(wǎng)產(chǎn)業(yè)相關(guān)市場(chǎng)界定提出解決方法。
[Abstract]:With the development of the Internet, more and more enterprises operate in the bilateral market. This special business model brings a new perspective to the antitrust analysis based on the industrial organization theory, and at the same time, it also brings great challenges. Whether traditional tools and emerging approaches for unilateral markets can be applied to bilateral markets will be a serious question. The new cases in judicial practice need to be answered by theoretical research. In the introduction part of this paper, the author first puts forward the questions, then expounds the background and significance of the selected topic, comments on the existing legal provisions and research results, and clarifies the present research situation and development trend at home and abroad. The text is divided into the following four parts: the first chapter, the basic theory of bilateral market, briefly introduces the concept of bilateral market, analyzes the externality of the cross-network of bilateral market, and the pricing mechanism of the two sides of the platform is different. Three features of alternative analysis of user locking down requirements. In the second chapter, the general theory of relevant market definition is introduced. The concept of relevant market and the definition of relevant market are three dimensions that need to be considered. The alternative analysis method and SSNIP test are used to define the relevant market. The third chapter, the dilemma of the definition of Internet industry related market under the bilateral market. Focusing on whether the definition of the relevant market of Internet industry should consider the bilateral market, the related regional market and the SSNIP test failure under the condition of the bilateral market, this paper sums up the difficulties of the definition of the relevant market from the theoretical and practical angles. The fourth chapter, under the bilateral market condition, the Internet industry related market defines the outlet. Focusing on the definition of fuzzy correlation market, improving the SSNIP test, attaching importance to the Internet-related regional market, and introducing the bilateral market ideas, the paper proposes a solution to the definition of the Internet industry-related market under the bilateral market.
