【摘要】：代理付款人不是票據(jù)當(dāng)事人,不承擔(dān)票據(jù)責(zé)任;其與票據(jù)權(quán)利人也不存在基礎(chǔ)關(guān)系,不應(yīng)直接對票據(jù)權(quán)利人承擔(dān)錯誤付款的責(zé)任。持票人開戶銀行只是代為付款提示,不是代理付款人,不應(yīng)承擔(dān)代理付款責(zé)任。同一系統(tǒng)銀行分支機構(gòu)擔(dān)任代理付款人的匯票只是對己匯票,不應(yīng)適用調(diào)整代理付款人與付款人關(guān)系的規(guī)則。代理付款人與出票人、承兌人之間的關(guān)系為基礎(chǔ)關(guān)系,應(yīng)適用票據(jù)法以外的法律。《票據(jù)法》規(guī)定代理付款人錯誤付款、對偽造、變造票據(jù)以及公示催告期間的票據(jù)付款應(yīng)自行負責(zé)混淆了票據(jù)基礎(chǔ)關(guān)系與票據(jù)關(guān)系,應(yīng)予修正。
[Abstract]:The agent drawee is not the party to the bill and does not bear the liability of the bill, nor does he have a basic relationship with the obligee of the bill, so he should not bear the responsibility of making the wrong payment directly to the obligee of the bill. The holder's account bank is merely presenting for payment, not acting drawee, and should not be liable for payment as agent. A bill of exchange acting as agent drawee in a bank branch of the same system shall not apply to the regulation of the relationship between the agent drawee and the drawee. The relationship between the agent drawee and the acceptor shall be based on the law other than the negotiable instrument law. The promissory note and the bill payment during the period of public notice shall be responsible for confusing the basic relationship between the bill and the bill, and should be amended.
