【摘要】：貨幣政策決策體制的法治建構(gòu)是推進(jìn)宏觀調(diào)控目標(biāo)制定和政策手段運(yùn)用機(jī)制化的關(guān)鍵。獨(dú)立決策、集體決策、科學(xué)決策、民主決策是貨幣政策決策體制的法治建構(gòu)原則。獨(dú)立決策是對(duì)貨幣政策決策外部影響的限制性原則,集體決策是對(duì)貨幣政策決策的內(nèi)部機(jī)構(gòu)、方式的程序性原則,科學(xué)決策和民主決策是相互制約的貨幣政策決策的價(jià)值性原則。1995年制定、2003年修改的《中國(guó)人民銀行法》雖然確立行長(zhǎng)負(fù)責(zé)制,但同時(shí)亦規(guī)定貨幣政策委員會(huì),立法猶疑于首長(zhǎng)型或委員會(huì)型的貨幣政策決策體制的選擇,存在較多權(quán)力黑箱。我國(guó)應(yīng)當(dāng)按照獨(dú)立決策、集體決策、科學(xué)決策、民主決策等四項(xiàng)法治建構(gòu)原則,尊重既有憲制安排,通過(guò)《中國(guó)人民銀行法》修改,以貨幣政策委員會(huì)為中心,推進(jìn)我國(guó)貨幣政策決策體制法治化。
[Abstract]:The construction of the rule of law in monetary policy decision-making system is the key to promote the establishment of macro-control objectives and the application of institutional policies. Independent decision, collective decision, scientific decision and democratic decision are the rule of law construction principle of monetary policy decision-making system. Independent decision making is the restrictive principle of external influence on monetary policy decision. Collective decision making is the procedural principle of the internal organization of monetary policy decision. Scientific and democratic decision-making are the value principles of monetary policy decisions which are mutually restricted. Although the Law of the people's Bank of China, enacted in 1995 and amended in 2003, establishes the responsibility system of the governor, it also stipulates that the Monetary Policy Committee, The legislation is hesitant in the choice of monetary policy decision-making system of the head type or the committee type, and there is more power black box. In accordance with the four principles of establishing the rule of law, namely, independent decision-making, collective decision-making, scientific decision-making and democratic decision-making, our country should respect the existing constitutional arrangements, amend the Law on the people's Bank of China and take the Monetary Policy Committee as the center. We will promote the legalization of the monetary policy decision-making system in China.
