企業(yè)內(nèi)部規(guī)章制度效力研究

【摘要】:企業(yè)內(nèi)部規(guī)章制度的合法完備以及是否能夠有效發(fā)揮其效力直接關(guān)乎著我國和諧勞動關(guān)系的構(gòu)建和法治社會的形成。然而,在當前的企業(yè)勞動用工實踐中,由于企業(yè)內(nèi)部規(guī)章制度不合理甚至違法、違規(guī)現(xiàn)象引發(fā)的侵害勞動者合法權(quán)益,從而引發(fā)的勞動爭議案件已經(jīng)不勝枚舉,屢見不鮮。于是,企業(yè)勞動規(guī)章制度中存在的問題應(yīng)得到重視和及時解決。本文以企業(yè)內(nèi)部規(guī)章制度為研究對象,試圖對其效力完善提出一些建議,以期更好地維護雙方權(quán)益。除去引言與結(jié)論,文章主體分為四部分:第一部分,企業(yè)內(nèi)部規(guī)章制度適用過程中存在的主要問題。這一部分主要是從搜集的與企業(yè)內(nèi)部規(guī)章制度適用有關(guān)的32則實務(wù)案例出發(fā),通過對案件判決結(jié)果和理由的仔細分析,剖析在企業(yè)內(nèi)部規(guī)章制度適用過程中存在的主要問題。首先,是是否符合企業(yè)規(guī)章制度的有效性標準問題,主要是從其內(nèi)容和程序兩個部分來闡述。其次,分析了勞動者嚴重違反企業(yè)內(nèi)部規(guī)章制度的“嚴重性”程度認定問題,司法機關(guān)關(guān)于“嚴重性”的不同衡量標準也直接關(guān)系著案件的不同裁判結(jié)果;最后,談到了影響企業(yè)內(nèi)部規(guī)章制度效力發(fā)揮的證據(jù)問題,這也是處理此類案件時不可忽視的又一重要問題。第二部分,企業(yè)內(nèi)部規(guī)章制度的性質(zhì)探討和效力表現(xiàn)。經(jīng)濟基礎(chǔ)決定上層建筑,我國法律設(shè)計目的的初衷也離不開促進經(jīng)濟的發(fā)展。在此部分,首先分析了企業(yè)內(nèi)部規(guī)章制度的經(jīng)濟學(xué)上的原理,然后再以此為基礎(chǔ)去探討其法律上的效力基礎(chǔ),最后分析了其性質(zhì)歸屬;其次結(jié)合審判實踐闡述了我國企業(yè)內(nèi)部規(guī)章制度效力的主要表現(xiàn)。第三部分,對企業(yè)內(nèi)部規(guī)章制度效力有效要件的反思。由于我國勞動基準法律并沒有對欠缺合法性要件時的企業(yè)內(nèi)部規(guī)章制度的效力作出明確規(guī)定,然而從司法實踐中的勞動糾紛來看,該問題也應(yīng)得到及時解決。本部分首先對其合法性標準進行了分析;然后對欠缺合法性要件時的企業(yè)內(nèi)部規(guī)章制度的效力進行探討;最后剖析了當前司法實踐中影響企業(yè)內(nèi)部規(guī)章制度效力發(fā)揮的主要原因。第四部分,提出完善我國企業(yè)內(nèi)部規(guī)章有效性的制度保障。本部分作為本文的落腳點,主要是針對上述影響企業(yè)內(nèi)部規(guī)章制度效力發(fā)揮的主要問題,同時汲取國外發(fā)達國家的先進經(jīng)驗,提出完善我國企業(yè)內(nèi)部規(guī)章有效性的制度保障,主要包括增加制定事前審查備案程序;強化勞資雙方的平等協(xié)商機制;細化企業(yè)內(nèi)部規(guī)章實施規(guī)則;加強對企業(yè)經(jīng)營自主發(fā)展權(quán)的規(guī)制。
[Abstract]:The legal perfection of the internal rules and regulations of enterprises and whether they can effectively exert their effects are directly related to the construction of harmonious labor relations and the formation of a society ruled by law. However, in the current practice of labor and employment in enterprises, due to unreasonable or even illegal internal rules and regulations of the enterprise, violations of the legal rights and interests of workers caused by the phenomenon, thus the labor dispute cases have been numerous, common occurrence. Thus, the existing problems in the enterprise labor rules and regulations should be paid attention to and solved in time. Taking the internal rules and regulations of enterprises as the research object, this paper tries to put forward some suggestions on the perfection of their effectiveness in order to better safeguard the rights and interests of both sides. Apart from the introduction and conclusion, the main body of the article is divided into four parts: the first part, the main problems in the application of internal rules and regulations. This part is mainly from the collection of 32 practical cases related to the application of internal rules and regulations of the enterprise, through the careful analysis of the results and reasons of the case judgment, the main problems existing in the application of the internal rules and regulations of the enterprise are analyzed. First of all, whether it conforms to the validity standard of enterprise rules and regulations, mainly from its content and procedure two parts to elaborate. Secondly, the author analyzes the problem of the degree of "seriousness" of the serious violation of the internal rules and regulations of the enterprise, and the different standards of the judicial organ on the "seriousness" are also directly related to the different adjudication results of the case. This paper discusses the evidence that affects the effectiveness of internal rules and regulations, which is also an important problem that can not be ignored in dealing with this kind of cases. The second part, the nature of the internal rules and regulations and the effectiveness of the performance. The economic base determines the superstructure, and the original intention of the legal design in our country is to promote the development of economy. In this part, we first analyze the economic principles of the internal rules and regulations of the enterprise, and then discuss its legal validity basis on this basis, and finally analyze the nature of the attribution; Secondly, it expounds the main performance of the effectiveness of internal rules and regulations of Chinese enterprises combined with the trial practice. The third part, the reflection on the effective elements of the internal rules and regulations. Because the labor standard law of our country has not made the explicit stipulation on the validity of the internal rules and regulations of the enterprise when it lacks the legality elements, however, from the view of the labor dispute in the judicial practice, the problem should be solved in time. In this part, the author first analyzes the legitimacy standard, and then discusses the effectiveness of the internal rules and regulations in the absence of the elements of legitimacy. Finally, it analyzes the main reasons that affect the effectiveness of internal rules and regulations in the current judicial practice. In the fourth part, the author puts forward the system guarantee to perfect the effectiveness of internal rules and regulations in our country. This part, as the foothold of this paper, mainly aims at the above main problems which affect the effectiveness of the internal rules and regulations of enterprises, and at the same time, draws on the advanced experience of foreign developed countries, and puts forward the system guarantee to improve the effectiveness of internal rules and regulations in our country. It mainly includes establishing the procedure of prior examination and filing, strengthening the equal consultation mechanism between employers and employees, refining the internal rules and regulations of the enterprise, and strengthening the regulation of the right to independent development of enterprise management.
