【摘要】：政府特許經(jīng)營(yíng)制度是公私合作模式(PPP)中一項(xiàng)重要的制度,是政府部門與民間機(jī)構(gòu)共同參與公用事業(yè)建設(shè)與運(yùn)營(yíng)管理的媒介。我國(guó)自2013年將公私合作模式(PPP)提升到國(guó)家政策層面以來,相關(guān)政府部門密集頒布了許多配套的規(guī)范性文件,有力的推動(dòng)了政府特許經(jīng)營(yíng)制度在我國(guó)的發(fā)展。政府特許經(jīng)營(yíng)者作為特許經(jīng)營(yíng)項(xiàng)目的重要參與者,他們的積極參與是特許經(jīng)營(yíng)項(xiàng)目成功的關(guān)鍵所在。但是,在我國(guó)目前特許經(jīng)營(yíng)項(xiàng)目的運(yùn)作實(shí)踐中,政府特許經(jīng)營(yíng)者的相關(guān)權(quán)益并沒有得到很好的保障,這將會(huì)導(dǎo)致公私合作模式難以實(shí)現(xiàn)其真正的制度價(jià)值。正是基于這種問題意識(shí),本文將結(jié)合相關(guān)理論與法律實(shí)踐,以政府特許經(jīng)營(yíng)制度中特許經(jīng)營(yíng)者的權(quán)益維護(hù)為研究重點(diǎn),希冀改變以往將政府監(jiān)管或者公共利益作為研究重點(diǎn)的思維路徑,將我們的關(guān)注點(diǎn)聚焦于特許經(jīng)營(yíng)者的權(quán)益保護(hù)研究問題。政府特許經(jīng)營(yíng)制度的生成前提與基礎(chǔ)是民間資本的積極參與,只有構(gòu)建出針對(duì)政府特許經(jīng)營(yíng)者權(quán)益科學(xué)合理的保障機(jī)制,才能更好的促進(jìn)政府特許經(jīng)營(yíng)制度乃至公私合作模式的良性發(fā)展。本文正是以政府特許經(jīng)營(yíng)者的權(quán)益保護(hù)為主線,從對(duì)政府特許經(jīng)營(yíng)者權(quán)益的理論闡釋入手,闡述特許經(jīng)營(yíng)者的特許經(jīng)營(yíng)權(quán)及其相關(guān)權(quán)利的生成途徑和內(nèi)容;隨后揭示出我國(guó)目前關(guān)于特許經(jīng)營(yíng)者權(quán)益保障的制度現(xiàn)狀與其所面臨的各種風(fēng)險(xiǎn),并結(jié)合對(duì)域外相關(guān)制度的考察分析,為本文所欲構(gòu)建的政府特許經(jīng)營(yíng)者權(quán)益的保護(hù)機(jī)制作出理論鋪墊。
[Abstract]:The government franchise system is an important system in the public-private partnership model. It is the medium for government departments and non-governmental organizations to participate in the construction and operation management of public utilities. Since our country promoted the public-private partnership model to the national policy level in 2013, the relevant government departments have issued a lot of supporting normative documents, which has promoted the development of the government franchise system in our country. Government franchisees as important participants in franchise projects, their active participation is the key to the success of franchise projects. However, the relevant rights and interests of government franchisees are not well protected in the practice of franchising projects in our country at present, which will lead to the difficulty of realizing the real institutional value of the public-private partnership model. Just because of this kind of problem consciousness, this article will combine the related theory and the legal practice, take the government franchisee's rights and interests safeguard in the government franchise system as the research emphases, We hope to change the way of thinking that government regulation or public interest is the focus of the research, and focus our attention on the research of franchisee's rights and interests. The premise and foundation of government franchise system is the active participation of private capital. Only by constructing a scientific and reasonable protection mechanism for the rights and interests of government franchisees, In order to better promote the government franchise system and public-private cooperation mode of benign development. This article takes the government franchisee's rights and interests protection as the main line, starts with the theoretical explanation of the government franchisee's rights and interests, expounds the franchising rights and the related rights' generation way and the content; Then it reveals the current situation of China's system on the protection of franchisees' rights and interests and the various risks it faces, and combines with the investigation and analysis of the relevant systems outside the country. It lays a theoretical foundation for the protection mechanism of the government franchisee's rights and interests.
