【摘要】：在基層執(zhí)法領(lǐng)域,控制違章建筑執(zhí)法具有一定的典型性與代表性,能夠?qū)?zhí)法面臨的諸多共性問(wèn)題以具有沖擊力的方式呈現(xiàn)出來(lái)。遵循執(zhí)法理論"綜合模式"的研究進(jìn)路,通過(guò)揭示基層執(zhí)法的形態(tài),在"社會(huì)-政制-法制"的系統(tǒng)互動(dòng)中,能夠深入理解其運(yùn)行機(jī)理�；鶎訄�(zhí)法的成敗得失,不僅關(guān)系到執(zhí)法目標(biāo)能否達(dá)成,還關(guān)系到在法治的維度上如何評(píng)價(jià)�；鶎訄�(zhí)法法治化的核心問(wèn)題是,在基層社會(huì)的特殊語(yǔ)境中,國(guó)家權(quán)力嵌入與運(yùn)作的合法性證成。具體地說(shuō),其法治徑路指向:一是,正確認(rèn)識(shí)基層執(zhí)法的兩重面向;二是,強(qiáng)調(diào)基層政權(quán)多層次的合法性塑造。
[Abstract]:In the field of law enforcement at the grass-roots level, the enforcement of illegal buildings is typical and representative, and can bring out many common problems faced by law enforcement in an impact way. Following the research approach of "comprehensive mode" of law enforcement theory, through revealing the form of law enforcement at the grass-roots level, we can deeply understand its operating mechanism in the systematic interaction of "social-constitution-legal system". The success or failure of law enforcement at the grass-roots level is not only related to whether the goal of law enforcement can be achieved, but also to how to evaluate it in the dimension of rule of law. The core problem of law enforcement at grassroots level is the legitimacy of the embedding and operation of state power in the special context of grass-roots society. To be specific, the path of ruling by law is: first, to correctly understand the dual aspects of law enforcement at the grass-roots level; second, to emphasize the legitimacy of the grass-roots regime at various levels.
